Since April 1, 2014, Resolution of the Council of Ministers of the Republic of Belarus No. 298 of April 1, 2014 "On approval of the Regulation on the procedure for reimbursement by a person to whom a land plot is granted of costs for the construction, including design, of distribution engineering and transport infrastructure facilities to such a land plot" has come into force.
The Regulation approved by this resolution defines the procedure for reimbursement by a person to whom a land plot is granted of costs for the construction, including design, of distribution engineering and transport infrastructure facilities to such a land plot, granted for the construction of apartment buildings, single-family, semi-detached residential buildings in areas (quarters) of individual housing construction, and construction of other facilities in the development area.
Reimbursement of costs for the construction, including design, of distribution engineering and transport infrastructure facilities to a land plot is carried out by a person to whom, in accordance with the legislation, a land plot is granted for the construction of apartment buildings, single-family, semi-detached residential buildings in areas (quarters) of individual housing construction, and construction of other facilities in the development area.
Reimbursement of costs for the construction, including design, of infrastructure facilities is not carried out by: persons to whom land plots are granted with payment for the right to conclude land lease agreements, as well as payment for land plots acquired into private ownership, if the costs for types of infrastructure facilities are included in the specified payment, who are registered as needing to improve their housing conditions.
In execution of clause 5 of the Regulation, the Beshenkovichi District Executive Committee, by decision No. 784 of August 18, 2015 "On establishing specific cost indicators for distribution engineering and transport infrastructure facilities," approved the specific cost indicators for the construction, including design, of distribution engineering and transport infrastructure facilities to a land plot per unit of capacity by type of infrastructure for 2015-2017 for categories of settlements in the Beshenkovichi District (urban-type settlement, agro-town, other rural settlements).
The reimbursable costs for each type of infrastructure facility provided for in the urban planning documentation shall be calculated by the developer of the project documentation for the construction of the facility.
The person to whom the land plot is granted shall send the calculation of the amount of reimbursable costs to the Beshenkovichi District Executive Committee.
The amount of costs to be reimbursed by citizens who are developers of single-family, semi-detached residential buildings shall be determined by the Beshenkovichi District Executive Committee when issuing permits for the construction of a single-family, semi-detached residential building by multiplying the specific cost of costs approved by decision No. 784 of the Beshenkovichi District Executive Committee of August 18, 2015, by the design capacity of the single-family, semi-detached residential building being constructed for each type of infrastructure facility provided for in the urban planning documentation.
Reimbursement of costs is made by transferring funds to the local budget to the account of the Main Treasury Department of the Ministry of Finance of the Republic of Belarus for the Vitebsk region, account No. 3600311003006, UNP 300594330 in branch No. 215 of OJSC "ASB Belarusbank" CBW No. 203 (bank code 150801647) (payment purpose: funds credited as reimbursement for construction costs, including design, of engineering and transport infrastructure for land plots provided for the construction of apartment buildings, single-family houses, townhouses in areas (blocks) of individual housing construction, construction of other facilities in the development area, payment code 4614). From the local budget, funds are transferred to the revenue of the budget from which the construction financing, including design, of infrastructure facilities was carried out.
The transfer of funds is made by the developer within the construction period of the construction object (apartment building, single-family house, townhouse, other facility in the development area) (but no later than the day of approval of the acceptance certificate for commissioned construction objects), taking into account indexation (in accordance with the Regulation).
