Information for citizens who own single-family and (or) terraced residential buildings in rural areas and the urban-type settlement of Beshenkovichi that are not used for permanent residence

          From December 4, 2018, the main provisions of Decree of the President of the Republic of Belarus No. 357 of September 4, 2018 "On vacant and dilapidated houses" come into force.

            By the order of the Chairman of the Beshenkovichi District Executive Committee dated November 5, 2018 No. 181r, a commission was created to inspect residential buildings. The commission identifies residential buildings that meet the criteria of vacant and dilapidated houses, draws up conclusions, and carries out work to locate owners and persons who have the right to own and use residential buildings.

          For vacant houses, persons who have the right to own and use residential buildings are sent notifications about the upcoming inclusion of residential buildings in the register of vacant houses.

            Persons who have the right to own and use residential buildings include:

            owners, including

heirs who have accepted the inheritance but have not registered their rights to the residential building in the manner prescribed by law;

            members, former members of the owner's family of the residential building, who have been granted the right to own and use the residential building;

            citizens residing in the residential building, provided by a testamentary bequest or on the basis of a lifetime maintenance agreement with dependency;

            tenants of the residential building;

            other persons in cases established by legislative acts.

           Please note that persons having the right to own and use the residential building, intending to use the residential building for residence, in respect of which they were sent a notification, submit a notification to the district, rural executive committee at the location of the residential building. At the same time, they must submit documents confirming the right along with the notification.

ownership and use of a residential building. The notification must be submitted no later than one month after the notification is served, or no later than one month after the information about the vacant house is published in periodic printed publications or other mass media.

            Failure by the owner to submit the notification within the period established by the Decree constitutes a renunciation of ownership of the residential building. The residential building will be included in the register of vacant houses by decision of the Beshenkovichi District Executive Committee. Then, within two months, an application is filed with the court to recognize the vacant house as ownerless and transfer it to the ownership of the Beshenkovichi District.

         The owner of a vacant house has the right to alienate it before receiving notification of the local executive committee's application to the court.

         Identified dilapidated houses are included in the register of dilapidated houses by decision of the Beshenkovichi District Executive Committee.

         Owners of dilapidated residential buildings  are sent  orders:  within one year to restore  the residential building for its intended use or to demolish it. If the owner fails to comply with the order within the established period, or if the owner refuses  to accept the order - fails to perform  measures for the restoration (reconstruction, demolition) of the dilapidated building  within a year from the date of  inclusion of the residential building in the register of dilapidated buildings  by the local executive committee, a decision is made:

          on the demolition of the dilapidated building, if there is written consent  from the owner for demolition;

          on applying to the court with a claim for the seizure of the dilapidated building from the owner and its transfer to the local executive committee for sale – in the absence of  the owner's consent  for demolition or if  restoration for intended use is possible.

          The owner of a dilapidated residential building  has the right to alienate it before receiving a notice of

submission  by  the  local  executive  committee of  an  application to  the  court.

         The  Decree  establishes:

         houses  in  which  persons  having  the  right  of  ownership  and  use  thereof  have  not  resided  for  any  day  during  the  last  three  years,  and  in  respect  of  which  no  notifications  of  intention  to  use  them  for  residence  have  been  provided,  are  recognized  as  vacant;

        residential  houses  in  a  state  of  emergency  or  threatening  to  collapse,  in  respect  of  which  local  executive  and  administrative  bodies  have  established  that  persons  having  the  right  of  ownership  and  use  thereof  have  not  resided  therein  during  the  last  year  and  are  not  taking  measures  to  restore  these  residential  houses  for  use  for  their  intended  purpose  (or  for  their  demolition),  are  recognized  as  dilapidated.
