To the attention of payers: on the timeliness of payment of family benefits

The Vitebsk region is observing a negative trend of an increasing number of cases of delayed payment of state benefits to families raising children by employers in the region.

According to the norms of Article 5 of the Law of the Republic of Belarus of December 29, 2012 No. 7-Z "On State Benefits for Families Raising Children" (hereinafter referred to as the Law), the employer is responsible for the timely and full payment of the specified benefits. Family benefits assigned at the recipient's place of work are paid for the current month on the days established for wage payment (Article 21 of the Law).

We draw the attention of employers that in case of untimely payment of wages, as well as if the amounts of payments accrued to the state social security fund are insufficient for the payment of state benefits, payers have the right to apply to the district (city) departments (sectors) of the Vitebsk Regional Fund Administration at the place of registration with an application for the transfer of funds for the payment of benefits and documents confirming the validity of the submitted application and the correctness of the benefit assignment (paragraphs 8, 9 of the Instruction on the procedure for using the funds of the state extra-budgetary social protection fund of the population of the Republic of Belarus for the payment of pensions and benefits, approved by the resolution of the board of the Social Protection Fund of the Ministry of Labor and Social Protection of the Republic of Belarus dated July 15, 2013 No. 9).

In cases where the payment of state benefits cannot be made at the place of employment due to the organization's lack of financial and economic activity, liquidation (

(being in the process of liquidation), undergoing insolvency (bankruptcy) proceedings, the payer has the right to submit applications of beneficiaries and supporting documents to the district (city) departments (sectors) of the Vitebsk Regional Fund at the place of registration for referral to the commission at the Vitebsk Regional Department of the Social Protection Fund for the appointment of benefits in exceptional cases to determine a new place of appointment and payment of state benefits (paragraph 22 of the Regulation on the procedure for appointing and paying state benefits to families raising children, approved by the Resolution of the Council of Ministers of the Republic of Belarus dated June 28, 2013 No. 569).

Enterprise managers must take measures to prevent arrears in the payment of benefits to families raising children. Violation of the rights of benefit recipients is a gross violation of legislation, which undermines the authority of the social security system.

For all issues related to the transfer of funds by the Fund's bodies to payers for the payment of benefits, the determination of a new place of assignment and payment of benefits, payers must contact the district departments.
