On Measures to Provide State Support. Decree No. 375 of October 1, 2021.

On October 1, 2021, the President of Belarus, Alexander Lukashenko, signed Decree No. 375 "On Measures to Provide State Support".
In accordance with the document, a comprehensive adjustment of legislation on providing state support to citizens for housing construction is envisaged.
In particular, amendments are made to the decrees: of January 6, 2012 No. 13 "On Certain Issues of Providing State Support to Citizens for the Construction (Reconstruction) or Acquisition of Residential Premises"; of August 4, 2017 No. 240 "On State Support for Citizens in the Construction (Reconstruction) of Residential Premises"; of December 10, 2018 No. 473 "On Shared Construction"; of August 30, 2005 No. 405 "On Certain Measures for the Construction of Residential Buildings (Apartments) in Rural Areas"; of September 2, 1996 No. 346 "On Certain Measures for the Development of Housing Construction in Rural Areas".
The proposed changes have been developed taking into account the appeals of citizens, legal entities and state administration bodies, as well as the practice of applying the decrees of the head of state.
The decree provides for state support to citizens improving their housing conditions not at the place of registration as needy. For example, state support will be provided to citizens registered as needy: in regional centers and the city of Minsk - when constructing housing in cities (except for regional centers and the city of Minsk), urban-type settlements and rural settlements; in cities of regional and district subordination - in urban-type settlements and rural settlements; in urban-type settlements - in rural settlements.
Residents of regional centers and the city of Minsk who are building (reconstructing) housing in small settlements (up to 20 thousand people) are granted the right to receive state support out of turn (before the Decree was adopted - in the general queue).
Additional protection of the interests of large families and families raising children with disabilities is envisaged. In particular, an increase in the age of children to 23 years, at which a large family is entitled to receive state financial assistance for the repayment of preferential loans or subsidies for the repayment of the principal amount of commercial loans (before the Decree was adopted - 18 years); provision of state support to large families living in rural settlements at a rate of 30 sq.m per family member, if both spouses work in such settlements; an increase in the amount of state support for families in which children acquired disabilities during the construction of housing.
In accordance with the document, additional protection of the interests of borrowers and their family members is provided. In particular, an increase in the period for citizens to return subsidies granted to them to the budget to 6 months in case of refusal to build housing (before the Decree was adopted - 3 months); in case of death of borrowers, the possibility for adult family members to obtain additional loans and receive subsidies in full (based on decisions made); the possibility of transferring debt on preferential loans to one of the former spouses, while retaining their right to receive financial assistance and deferral of loan repayment.
