On the issues of liability for participation in unauthorized mass events
The procedure for organizing and holding mass events is regulated by Law of the Republic of Belarus No. 114-Z of December 30, 1997 "On Mass Events in the Republic of Belarus", the provisions of which are aimed at creating conditions for the realization of constitutional rights and freedoms of citizens, as well as ensuring public safety and order during these events on streets, squares and other public places.
In accordance with the norms of this Law, a mass event can be held with the appropriate permission of the local executive and administrative body.
In case of violation of the established procedure for holding assemblies, rallies, street processions, demonstrations, pickets, other mass events, committed by a participant in such events, as well as public calls for the organization or holding of such events, a person may be brought to administrative responsibility under Article 23.34 of the Code of Administrative Offenses of the Republic of Belarus (entails a warning, a fine, or administrative arrest), and for organizing group actions that grossly violate public order and are associated with clear disobedience to legal requirements, enterprises, institutions or organizations, or active participation in such actions in the absence of signs of a more serious crime – to criminal responsibility under Part 1 of Article 342 of the Criminal Code of the Republic of Belarus (punishable by a fine, or arrest, or restriction of liberty for up to three years, or deprivation of liberty for the same term).
For committing offenses or crimes specified above by minors who have not reached the age of administrative or criminal responsibility, on the basis of Article 9.4 of the Code of Administrative Offenses of the Republic of Belarus, parents or persons replacing them who have not fulfilled their duties to raise children may be brought to administrative responsibility (in the form of a warning or a fine).
The main principle of the work of law enforcement agencies in the Republic of Belarus, as well as civil society as a whole, is not the essence of punishment for an offense, but the ability to prevent and preclude the commission of similar actions in the future.
During the elapsed period of 2020, the district prosecutor's office issued 7 official warnings about the inadmissibility of violating the law on mass events, including 1 to a minor.
