On the payment of wage arrears

The district prosecutor's office has received an increased number of appeals from citizens regarding the possibility of recovering wage arrears and other labor disputes, in connection with which I provide the following clarification.

In accordance with the provisions of the Labor Code of the Republic of Belarus, labor disputes include unresolved disagreements between parties to labor and related relations regarding the application of labor legislation, including issues of transfer, relocation, wage payment, and final settlement upon dismissal.

According to Article 233 of the Labor Code of the Republic of Belarus, individual labor disputes concerning the application of labor legislation are considered by the labor dispute commission and the courts.

Also, in accordance with Part 4 of Article 241 of the Labor Code of the Republic of Belarus and Part 2 of Article 285 of the Special Part of the Tax Code of the Republic of Belarus, employees are exempt from paying state duty and court costs for filing applications in court for individual labor disputes and during the consideration of these disputes by the court.

Under such circumstances, if an employee believes that their rights have been violated, they are entitled to independently apply to the labor dispute commission (if available at the employer) or directly to the court at the main location of the enterprise to resolve the disputes that have arisen.

Additionally, I inform you that in accordance with Part 1 of Article 242 of the Labor Code of the Republic of Belarus, employees apply to the court within 3 months from the day they became aware or should have become aware of the violation of their rights, and in cases of dismissal – to the court within one month from the date of delivery of a copy of the dismissal order or from the date of issuance of the employment record book with an entry on the grounds for termination of the employment contract, or from the date of refusal to issue or receive the specified documents.
