On Amendments to the Law of the Republic of Belarus "On Atmospheric Air Protection"
On January 23, 2024, the Law of the Republic of Belarus of July 17, 2023 No. 295-Z "On Amendments to the Law of the Republic of Belarus "On Protection of Atmospheric Air" came into force.
In connection with the entry into force of the Law of the Republic of Belarus of July 17, 2023 No. 295-Z "On Amendments to the Law of the Republic of Belarus "On Protection of Atmospheric Air" (hereinafter referred to as Law No. 295-Z), which amended certain provisions on air protection regulation, legal entities and individual entrepreneurs whose activities are related to the production (generation) of energy using waste of hazard classes 1-3 and (or) waste neutralization at facilities affecting atmospheric air, must obtain permits for emissions of pollutants into the atmospheric air or integrated environmental permits for such facilities by July 23, 2024.
As part of bringing the legislation into compliance with Law No. 295-Z, the Resolution of the Council of Ministers of the Republic of Belarus of December 20, 2023 No. 921 was adopted, which restates in a new edition the Regulation on the Procedure for Issuing Permits for Emissions of Pollutants into Atmospheric Air, approved by the Resolution of the Council of Ministers of the Republic of Belarus of May 21, 2009 No. 664.
From January 23, 2024, the air pollutant emission inventory report, according to which the total gross emissions of pollutants are 3 tons per year or less, or the gross emissions of hazard class 1 pollutants are 10 or lesskilograms per year, is subject to approval at the place of state registration of the applicant by the regional (Minsk city) committee of natural resources and environmental protection (subparagraph 6.21.5 of the Unified List of administrative procedures carried out in relation to business entities, approved by the Resolution of the Council of Ministers of the Republic of Belarus of September 24, 2021 No. 548). This requirement does not apply to acts of inventory of emissions of pollutants into the atmosphere, approved by legal entities and individual entrepreneurs before January 23, 2024.
Resolution No. 664 (as amended by Resolution No. 921) establishes categories of objects affecting the atmosphere and lists of objects affecting the atmosphere belonging to different categories.
The Law provides for a number of other amendments aimed at improving the efficiency of atmospheric air protection.
