On Citizens' Appeals

The right of applicants to appeal is enshrined in the Law of the Republic of Belarus "On Appeals of Citizens and Legal Entities". The District Prosecutor's Office continuously conducts explanatory work on the application of current legislation in this area.

Based on the requirements of Decree of the President of the Republic of Belarus No. 489 of October 15, 2007 "On Additional Measures for Working with Appeals of Citizens and Legal Entities", appeals from citizens and legal entities, regardless of which state body or other organization they were submitted to, are initially subject to substantive consideration in accordance with their competence. The list of bodies responsible for considering appeals in various spheres of public life is approved by this Decree.

At the same time, the District Prosecutor's Office continues to receive a significant number of appeals, the consideration of which is not within the competence of the prosecutor's office. In 2019, about two dozen appeals were forwarded for consideration to other departments. In turn, forwarding appeals for consideration to authorized bodies not only requires certain costs but sometimes delays the resolution of urgent problems of citizens.

In this regard, we would like to once again draw the attention of our applicants to the need to comply with the requirements of the aforementioned Decree of the Head of State.

In 2019, 52 appeals from citizens were resolved directly by the District Prosecutor's Office. Over 70 citizens personally attended receptions with prosecutor's employees.

During the specified period, more appeals were substantively considered regarding the enforcement of legislation by enforcement bodies, and supervision over the legality of court decisions in criminal cases. At the same time, the number of appeals concerning compliance with legislation in administrative proceedings and labor legislation slightly increased.

Despite the decrease in the number of appeals considered regarding investigation and inquiry, a high proportion of satisfied appeals in this category is noted.

The main reasons for substantiated complaints about the actions and decisions of investigators and interrogators are incomplete checks on applications and reports of crimes, violations of the norms of the Criminal Procedure Code of the Republic of Belarus, and the adoption of illegal and unfounded decisions. Also, a significant number of violations are committed by police officers during administrative proceedings.

It should be noted that the District Prosecutor's Office, within its powers, significantly influences the improvement of the quality of work of the district's law enforcement agencies in this direction. Based on the results of supervisory measures, the District Prosecutor's Office prepared more than 20 acts of prosecutorial response, as a result of the consideration of which disciplinary and material measures were taken against more than 30 law enforcement officers of the district.
