On Eliminating Violations of Legislation Aimed at Ensuring the Safety of Minors – The Prosecutor's Office Conducted an Inspection
The Beshenkovichi District Prosecutor's Office conducted an inspection of the work on enforcing legislation on preventing child fatalities from external causes, during which violations requiring corrective measures were identified.
In accordance with the requirements of Directive No. 1 of the President of the Republic of Belarus dated March 11, 2004, "On Measures to Strengthen Public Safety and Discipline" (hereinafter – Directive No. 1), leaders at all levels are instructed to take comprehensive measures to ensure the safety of human life and health. According to Part 1 of Article 181 of the Code of the Republic of Belarus on Marriage and Family, a child has the right to special, preferential, and priority care, both from parents and from the state.
To implement these legislative requirements, a passport (list) of potentially dangerous objects and places of stay for minors in the Beshenkovichi district has been compiled.
However, work with this passport and the objects included in it has not been established.
During the inspection, it was found that since the formation of the list (passport) of potentially dangerous objects, no changes (additions, exclusions) have been made to it.
Thus, as of today, a number of included objects have ceased to exist but are still listed in the passport.
For example, the former store in the village of Selishche (demolished), the former building of the livestock farm in the village of Lug (reconstructed), the administrative building of UE "PlissyAgro" (demolished), the building of the former club in the village of Zabelie (demolished), the farm building in the village of Vyazhishche (demolished), the former building of the Bocheikovskaya hospital (demolished), the unfinished building on the territory of the State Educational Institution "Secondary School No. 1 of Beshenkovichi" (demolished), and others.
Conversely, there are also a number of objects in the district not included in the list (passport).
For example, the building of the former cultural center in the village of Rubezh is in disrepair, its ceiling slabs are collapsing, wooden beams have rotted, and there is partial collapse of bricks and slate. However, there is free access to the premises of this object, which poses a threat to the life and health of citizens, including minors.
There is clear evidence of repeated unauthorized entry into the vacant premises, as indicated by the accumulation of household waste and empty alcohol bottles.
The district prosecutor's office also identified the following objects not included in the list (passport), but similarly posing a threat to life and health, including: a semi-ruined uninhabited house (unnumbered) in the village of Pyatigorsk (Tsentralnaya Street); the former post office building in the agro-town of Svecha; a complex of agricultural organization buildings in the village of Rubezh (at the entrance from Beshenkovichi); an abandoned single-story house in the agro-town of Dvor Nizgolovo; the former boiler house building in the agro-town of Svecha (near residential building No. 3 on Zelenaya Street).
It should also be noted that a number of buildings were demolished to exclude them from the list of potentially dangerous objects, but the remaining construction debris does not allow them to be considered safe.
For example, such facts were found at the demolition sites of the "primary school building" (in the village of Strizhevo) and the "former rural council building" (village of Rubezh).
The list (passport) of potentially dangerous objects in the Beshenkovichi district identifies the organizations responsible for these objects.
However, during the inspection, it was noted that no work is being carried out with the owners by the district executive committee. Violations are eliminated only by actof prosecutorial supervision (for example, according to the order of the district prosecutor's office dated 27.03.2020, measures were taken to restrict access to a two-story building in the village of Rubezh and a bath and laundry complex in the agricultural town of Verkhnee Krivino, excluding the possibility of unauthorized entry).
Based on the identified violations, the district prosecutor's office submitted a representation to the Beshenkovichi District Executive Committee, containing a number of requirements aimed at organizing work in this area (including raising the issue of responsibility of the guilty officials). The execution of the act of supervision is under control of the district prosecutor's office.
