New in Administrative Liability for Occupational Safety and Health Violations.
In 2020, the Vitebsk Regional Department of the State Inspectorate Department of the Ministry of Labor and Social Protection of the Republic of Belarus conducted 4 special investigations of occupational accidents in the Beshenkovichi district, including: 1 group accident involving two employees; 3 accidents resulting in severe industrial injuries.
Based on the results of the special investigation, 4 officials and 2 employees were identified as having committed violations of labor and occupational safety and health legislation, technical regulatory legal acts, and local regulatory legal acts.
During the special investigations into compliance with occupational safety and health legislation, 4 officials were identified and brought to administrative responsibility for violations of occupational safety rules under Article 9.17 of the Code of Administrative Offenses of the Republic of Belarus.
On March 1, 2021, the new Code of Administrative Offenses of the Republic of Belarus comes into force. The updated Code has changed the structure of articles and introduced many amendments. These changes also affected violations in the field of occupational safety and health.
Administrative liability for occupational safety and health violations is established by Article 10.3 of the Code of Administrative Offenses. Now:
violation of occupational safety and health requirements by an official or other authorized person of the employer or an individual entrepreneur (Part 1, Article 10.13) – entails a fine ranging from five to forty basic units;
if the specified act resulted in injury to employees (Part 2, Article 10.13), this entails a fine ranging from twenty to fifty basic units.
One of the innovations is bringing not only responsible persons but also employees (Part 3, Article 10.13) to administrative responsibility, which entails a fine of up to five basic units.
