Compliance with Labor Protection Legislation
During the analysis of inspections and monitoring of organizations in the Vitebsk region (of all forms of ownership), violations are periodically identified regarding the failure of organization heads and members of commissions to pass knowledge tests on labor protection, the presence of deficiencies, the procedure for implementing, and the effectiveness of the Labor Protection Management System.In this regard, the Vitebsk Regional Department of the State Labor Inspectorate draws the attention of organization heads to the following requirements of current labor protection legislation, regarding the necessity of mandatory fulfillment by employers of labor protection duties defined by the Labor Protection Law:
1. According to Article 17 of the Law of the Republic of Belarus of June 23, 2008 "On Labor Protection" (as amended by the Law of the Republic of Belarus of July 12, 2013, No. 61-Z) and paragraph 8 of Article 226 of the Labor Code of the Republic of Belarus (with amendments and additions), employers of all forms of ownership are obliged to ensure the development, implementation, and maintenance of a labor protection management system (hereinafter referred to as LPMS) that ensures hazard identification, professional risk assessment, determination of professional risk management measures, and analysis of their effectiveness, as well as the development and implementation of measures to improve working conditions and labor protection;
2. According to Article 17 of the Law of the Republic of Belarus "On Labor Protection" and paragraph 39 of the Resolution of the Ministry of Labor and Social Protection of the Republic of Belarus of November 28, 2008, No. 175 "On Approval of the Instruction on the Procedure for Training, Internship, Briefing, and Knowledge Testing of Employees on Labor Protection Issues" (with amendments and additions), managers and specialists are obliged, no later than one month from the date of appointment to the position and periodically in accordance with the requirements of regulatory legal acts, but at least once every three years, to undergo knowledge testing on labor protection issues in the relevant commissions for knowledge testing on labor protection issues.
The Vitebsk Regional Department of the State Labor Inspectorate also informs that heads of organizations have the right to submit an application for an unscheduled inspection of the organization to the Vitebsk Regional Department of the State Labor Inspectorate, in accordance with the requirements of Decree No. 510 of October 16, 2009 "On Improving Control (Supervisory) Activities in the Republic of Belarus" (with amendments and additions).
(For reference: these inspections are carried out without applying sanctions to the employer, and the justification for conducting such inspections is particularly relevant in newly created organizations to ensure safe work production during the 2-year period when, in accordance with the requirements of Decree No. 510, full inspections of organizations cannot be carried out).

The Ministry of Labor and Social Protection informs the following.
As of January 19, 2021, Resolution of the National Statistical Committee of the Republic of Belarus of September 25, 2020, No. 85 "On Approval of the Form of State Statistical Reporting 2-Working Conditions (Ministry of Labor and Social Protection) "Report on Working Conditions" and Instructions for its Completion" [1] came into force.In accordance with this resolution, respondents of state statistical reporting 2-working conditions (Ministry of Labor and Social Protection) "Report on working conditions" (hereinafter - report 2-working conditions) for the first half of 2021 shall generate and submit the report in the form of an electronic document and sign it with an electronic digital signature.
The generation and submission of report 2-working conditions will be carried out through the automated information system "Monitoring of working conditions in production" (hereinafter - AIS).
It should be noted that employers also generate documents on the results of workplace certification for working conditions in electronic form through the AIS.
Currently, user access to the AIS is provided upon request from legal entities that have workplaces with harmful and (or) hazardous working conditions, to the email address of the information support service of the Republican Unitary Enterprise "Center for Information Technologies of the Ministry of Labor and Social Protection of the Republic of Belarus" arm@mintrud.by.
To register an organization in the AIS system and receive instructions for system administrators, legal entities must fill out the Questionnaire for the administrator of the organization's personal account in the AIS "Monitoring of working conditions in production" (hereinafter - Questionnaire).

After filling out the Questionnaire, it must be sent to the email address arm@mintrud.by with the subject "Registration in AIS Monitoring of working conditions" by February 26, 2021.

Resolution of the National Statistical Committee of the Republic of Belarus dated March 28, 2016 No. 16 "On approval of the form of state statistical reporting 4-labor protection (Ministry of Labor and Social Protection) "Report on working conditions and labor protection" and instructions for its completion" has been declared invalid (paragraph 3 of the Resolution of the National Statistical Committee of the Republic of Belarus dated September 25, 2020 No. 85).
