MEMORANDUM on the sale of commercial timber to individuals in harvested form outside of exchange trading
Roundwood is sold outside of exchange trading on the basis of the Rules for the Sale of Timber approved by Decree of the President of the Republic of Belarus of August 22, 2022 No. 294, and the requirements of the resolution of the Ministry of Forestry of the Republic of Belarus of September 14, 2022 No. 14.
I. Sale Conditions
1. Roundwood can be sold to individuals:
- at the price of manufacturing organizations, not tied to the exchange quotation (hereinafter - the preferential price);
- at the price of manufacturing organizations, not lower than the exchange quotation (hereinafter - the market price).
II. Sales Procedure - for construction, including reconstruction or major repairs, of residential buildings or outbuildings – up to 70 cubic meters;
- for current repairs of residential buildings, outbuildings, fences of land plots, objects located on the territory of a gardening partnership or dacha cooperative owned by individuals – up to 10 cubic meters.
2. Procedure for selling timber at a preferential price.
2.1. A citizen submits an APPLICATION to the forestry enterprise, indicating:
for construction:
- purpose of timber acquisition;
- volume;
- details of documents (name, date, and number (if any)):
document confirming the right to the land plot (district executive committee's decision on allocating a plot for real estate construction; state act on land plot allocation);
documentation for the construction of the facility (project estimate or cost estimate documentation developed and approved in accordance with legislative requirements);
During reconstruction ormajor repairs:
- purpose of timber acquisition;
- volume;
- address of the real estate property for which reconstruction or major repairs are requested and for which timber is sought;
- details of documents (name, date, and number):
document confirming state registration of real estate (property registration certificate or other document,
confirming the ownership of the said property);reconstruction (major overhaul) documentation for the facility (design and estimate or estimate documentation developed and approved in accordance with the requirements of the legislation);
for current repairs:
- purpose of timber acquisition;
- volume;
- address of the real estate object for which current repairs are requested and timber is sought;
- document details (name, date, and number):
document confirming state registration of real estate (property registration certificate or other document confirming ownership of the property).
In the case of gardening associations – a decision on granting an individual a land plot for personal subsidiary farming.
2.2. The forestry enterprise shall notify the applicant of the availability (or unavailability) of the requested volume of timber within 15 CALENDAR days from the date of application registration.
2.3. If the requested timber is available at the forestry enterprise, the citizen shall visit the forestry enterprise on the date appointed by the forestry enterprise and present the documents whose details were indicated in the application. The forestry enterprise shall make copies of the documents and attach them to the application.
THE AGREEMENT is signed after verification of the details of the provided documents against the information specified in the application.
The Standard Form of the Agreement is provided by the order of the Ministry of Forestry dated September 14, 2022 No. 14.
2.4. If the forestry enterprise is **unable to satisfy the application** within 10 CALENDAR days from the date of its registration, it shall forward the application to the State Forest Management Organization with justification of the reasons for the unavailability of the requested timber.
The forestry enterprise shall send the options for satisfying the application proposed by the State Forest Management Organization to the applicant within 5 CALENDAR days, along with the justification of the reasons for its refusal.
2.5. If a citizen has not provided a report on the use of timber by November of the year in which the timber was acquired, the forestry enterprise shall inform the citizen by December 1 of the need to provide such a report or
provide information explaining the impossibility of submitting such a report.
3. Action Algorithm for Selling Timber at the Price of Manufacturing Organizations Not Lower Than the Exchange Quotation (Market Price).
3.1. Timber is sold at the market price without volume restrictions in cases not covered by paragraph 2 of the second section of these guidelines or in excess of the volumes specified in paragraph 1 of the second section of these guidelines.
3.2. A citizen submits an APPLICATION to the forestry enterprise, specifying the volume and other characteristics of the timber.
3.3. The timeframes for considering such applications are not standardized.
3.4. A contract for the supply of products may
shall be concluded on the day of application submission. The form of such agreement shall not contradict the requirements of the legislation.
3.5. The volume of sale of such products is unlimited. The types of logging for harvesting such timber are unlimited.
