The Beshenkovichi District Prosecutor's Office supported the state prosecution in an on-site court session for repeated driving under the influence of alcohol
During the preliminary and judicial investigation of this criminal case, it was established that a local resident, having been brought to administrative responsibility under Part 1 of Article 18.16 of the Code of Administrative Offenses of the Republic of Belarus of 2003 for driving a vehicle under the influence of alcohol and subjected to an administrative penalty in the form of a fine, with deprivation of the right to drive vehicles for three years, within a year after the imposition of the administrative penalty, intentionally on May 22, 2021, while under the influence of alcohol, without the right to drive vehicles, drove a vehicle - an MTZ-80l tractor with a feed distributor, and while driving to the urban settlement of Beshenkovichi, was stopped and detained by an officer of the State Automobile Inspectorate of the Beshenkovichi District Department of Internal Affairs.
To establish the state of alcoholic intoxication, an examination was conducted.
Taking into account the position of the state prosecutor, the court found the said citizen guilty of driving a vehicle while under the influence of alcohol, committed within a year after the imposition of an administrative penalty for such a violation, and on the basis of Part 1 of Article 317-1 of the Criminal Code of the Republic of Belarus, a punishment was imposed in the form of restriction of liberty for a period of 1 year and 6 months without referral to an open-type correctional institution, with deprivation of the right to engage in activities related to driving vehicles for a period of 5 years, with a fine of 200 basic units amounting to 5800 rubles.
The MTZ-80l tractor, as a means of committing the crime, was gratuitously seized into state ownership (special confiscation was applied).
The verdict was not appealed or protested and entered into legal force.
For reference, over the past 6 months of the current year, officers of the State Automobile Inspectorate of the Beshenkovichi District Department of Internal Affairs have identified more than 1600 various traffic violations, of which at least 20 were driving under the influence of alcohol, and more than 40 were driving vehicles without a license.
