The District Prosecutor's Office took measures to protect the property rights of an elderly resident of our district

The District Prosecutor's Office took measures to protect the property rights of an elderly resident of our district.

During an organized reception at the place of residence, the District Prosecutor's Office visited a resident of the agro-town of Bocheikovo, who appealed to the prosecutor's employee for assistance in protecting her violated property rights.
Based on this fact, the District Prosecutor's Office organized and conducted a relevant investigation. The applicant's arguments were confirmed, and the district prosecutor filed a statement of claim with the Beshenkovichi District Court in the interests of the citizen.
For reference, it was established in the case that one of the residents of our district, born in 1996, on March 11, 2020, at about 12:00, while on the adjacent territory of one of the houses in the agro-town of Bocheikovo, secretly, by theft, committed a petty larceny of 114 kilograms of metal products, namely pipes and a grate, thereby causing material damage to the elderly applicant.
For this fact, the said citizen was also brought to administrative responsibility by the Beshenkovichi District Court under Part 1 of Article 10.5 of the Code of Administrative Offenses of the Republic of Belarus for committing petty larceny and was subjected to an administrative penalty in the form of a fine. The damage was not voluntarily compensated to the citizen.
In accordance with Article 933 of the Civil Code of the Republic of Belarus, damage caused to a citizen's property is subject to full compensation by the person who caused the damage.
It should be noted that lawsuits filed by the prosecutor are considered with the mandatory participation of a representative of the supervisory authority.
Thus, a court hearing was held with the participation of Deputy Prosecutor V.V. Doylidov, during which the evidence collected by the district prosecutor's office was examined, and a relevant conclusion was provided.

The Beshenkovichi District Court fully satisfied the prosecutor's statement of claim in the interests of the citizen, and the damage was recovered from the offender.
The court decision has entered into force.
