Prosecutor of Beshenkovichi District Sent Criminal Case on Illegal Actions with Explosives to Court

The prosecutor of Beshenkovichi District sent a criminal case to court against a district resident for committing illegal actions with explosives.

According to the case materials, D., previously convicted, from January 2017 to May of the current year, illegally acquired an explosive substance – smokeless gunpowder of industrial production – which he found in his house of residence and which had been left there by the previous owner. Understanding its purpose, he stored it at his place of residence until it was seized by internal affairs officers.

After reviewing the materials of the criminal case, the prosecutor concluded that the accusation was substantiated and the circumstances of the crimes were objectively investigated, agreeing with the qualification of D.'s actions under Part 2 of Article 295 of the Criminal Code of the Republic of Belarus.

It should be noted that in the current year, 13 crimes related to illegal actions with firearms, ammunition, and explosives have been registered in the district. Currently, the prosecutor has sent 5 criminal cases to court for consideration.

Depending on the nature of the actions committed, the sanction of Article 295 of the Criminal Code of the Republic of Belarus provides for various types of penalties, up to 12 years of imprisonment. In addition, the accused may be additionally fined up to one thousand basic units, and for committing a crime under Part 4 of Article 295 of the Criminal Code of the Republic of Belarus, the amount of the fine is set within the range of five hundred to fifty thousand basic units.

It should be reminded that in case of voluntary surrender of items,specified in Articles 295- 297of the Criminal Code of the Republic of Belarus, a person is exempted from criminal liability for actions provided for by these articles, except for cases of sale. It should also be understood that voluntary surrender is recognized when a person, having the opportunity to continue possessing any of these items, voluntarily, regardless of motives, transfers them or information about their location to representatives of the authorities.
