On Approval of the Regulation on Social Services in a Foster Family and Amendments and Additions to Certain Resolutions of the Council of Ministers of the Republic of Belarus
Amendments and additions:
Resolution of the Council of Ministers of the Republic of Belarus dated September 17, 2020 No. 538 (National Legal Internet Portal of the Republic of Belarus, 26.09.2020, 5/48378)
Based on sub-paragraph nine of Article 13 of the Law of the Republic of Belarus dated May 22, 2000 No. 395-Z "On Social Services", the Council of Ministers of the Republic of Belarus RESOLVES:
1. To approve the Regulation on Social Services in a Foster Family (attached).
2. To introduce additions and amendments to the following resolutions of the Council of Ministers of the Republic of Belarus:
2.1. in the Regulation on the Ministry of Labor and Social Protection of the Republic of Belarus, approved by Resolution of the Council of Ministers of the Republic of Belarus dated October 31, 2001 No. 1589 "Issues of the Ministry of Labor and Social Protection of the Republic of Belarus" (National Register of Legal Acts of the Republic of Belarus, 2001, No. 105, 5/9329; 2005, No. 24, 5/15563; 2009, No. 304, 5/30924; National Legal Internet Portal of the Republic of Belarus, 06.01.2013, 5/36729; 28.09.2016, 5/42657):
2.1.1. in paragraph 6:
sub-paragraph 6.52 after the word "employees," shall be supplemented with the words "including medical workers in agreement with the Ministry of Health,";
sub-paragraph 6.411 shall be set forth as follows:
"6.411. conducts activities, including competitions (reviews, review competitions), aimed at:
generalizing and disseminating best practices in the field of social services, improving the quality of social services;
improving the professional skills of employees of state organizations subordinate to the Ministry of Labor and Social Protection;
strengthening the institution of family;";
2.1.2. in paragraph 7:
in sub-paragraph 7.1.12, the words ", providing inpatient social services," shall be deleted;
the paragraph shall be supplemented with sub-paragraph 7.1.161 of the following content:
"7.1.161. requirements for the content and quality of social services provided within the framework of state minimum social standards in the field of social services;";
2.2. in the Regulation on the procedure, features and grounds for providing citizens with special residential premises of the state housing stock in boarding houses for the elderly and disabled, boarding houses for disabled children, special homes for veterans, the elderly and disabled, approved by Resolution of the Council of Ministers of the Republic of Belarus dated September 24, 2008 No. 1408 "On Special Residential Premises of the State Housing Stock" (National Register of Legal Acts of the Republic of Belarus, 2008, No. 237, 5/28424; 2009, No. 171, 5/30157; National Legal Internet Portal of the Republic of Belarus, 07.07.2012, 5/35920; 29.05.2013, 5/37295; 17.02.2017, 5/43337):
2.2.1. in paragraph 4:
the second sub-paragraph after the words "up to 1 month" shall be supplemented with the words ", but no more than three times in a calendar year";
the third sub-paragraph after the word "permanent" shall be supplemented with the words "or temporary (up to one year)";
2.2.2. paragraph 9 shall be set forth as follows:
"9. Special residential premises in special homes are provided for assisted living services to disabled persons of groups I and II with moderate or severe self-care impairment from among:
persons residing in boarding homes for disabled children, general boarding homes, neuropsychiatric boarding homes;
disabled persons with musculoskeletal disorders who do not own residential premises and persons legally obliged to support them.
Minor children of citizens specified in the first part of this paragraph shall be provided with special residential premises in special homes for the period of their parents' residence in special homes, but not longer than until they reach the age of majority.
Subject to availability, by decision of the relevant local executive and administrative bodies, special residential premises in special homes may be provided for assisted living services to disabled persons of groups I and II with moderate or severe self-care impairment from among disabled persons with musculoskeletal disorders who do not own residential premises and live separately from adult children, spouses, and parents who are not disabled persons of group I or II and have not reached the age entitling them to an old-age pension on general grounds.";
2.2.3. in paragraph 11:
in the eighth paragraph of the first part of paragraph 11, replace the words "paragraph 7" with the words "paragraphs 6 and 7";
add the words ", neuropsychiatric boarding homes" after the words "general type" in the second paragraph of the second part;
2.2.4. in paragraph 17:
add an eighth paragraph to the first part as follows:
"documents confirming the right to social benefits.";
add the words ", a copy of the inventory of property belonging to the person in need of protection of property rights, and a decision on the appointment of a guardian over the property (if any)" to the second part;
2.3. in the Resolution of the Council of Ministers of the Republic of Belarus dated December 27, 2012, No. 1218 "On some issues of providing social services" (National Legal Internet Portal of the Republic of Belarus, 11.01.2013, 5/36756; 13.03.2015, 5/40231; 17.02.2017, 5/43337):
2.3.1. in the sixth paragraph of paragraph 2, replace the word "socio-medical" with the word "social";
2.3.2. in the list of free and publicly available social services of state social service institutions with norms and standards for the provision of these services to citizens, approved by this resolution:
the title of the section "Social services provided by state social service institutions providing inpatient social services, regardless of their type" shall be stated as follows:
"Social services provided by state boarding homes for the elderly and disabled, boarding homes for disabled children";
in sub-paragraph 2.12 of paragraph 2, replace the words "once a month" with the words "as needed";
exclude paragraph 3;
add sub-paragraph 5.13 to paragraph 5 as follows:
"5.13. assistance in obtaining medical care | according to medical indications"; |
add sub-paragraph 7.6 to paragraph 7 as follows:
"7.6. organization of therapeutic and labor activities (in therapeutic and labor workshops, interest groups, subsidiary farms, etc.) | as prescribed by a specialist doctor"; |
the title of the section "Social services provided by state social service institutions providing inpatient social services, depending on their type" shall be stated as follows:
"Individual social services provided by state residential care homes for the elderly and disabled, residential care homes for disabled children, special homes for veterans, the elderly and disabled";
in paragraphs 9 and 10, the word "socio-medical" shall be deleted;
paragraphs 15 and 28 after the word "disasters" shall be supplemented with the words ", persons from among orphans and children left without parental care";
paragraph 17 shall be deleted;
in paragraph 18:
in sub-paragraph 18.9, the words ", provided for in paragraph 17 of this list" shall be deleted;
sub-paragraph 18.18.6 after the words "on visiting days of the institution" shall be supplemented with the words "in the form of social services at home for citizens with limited vital activity (ability to self-care), corresponding to FC 4****, if necessary";
the paragraph shall be supplemented with sub-paragraph 18.24 as follows:
"18.24. delivery (provision) of medicines and medical devices | in the form of inpatient social services - as prescribed by a specialist doctor |
paragraph 19 shall be deleted;
paragraph 22 shall be supplemented with sub-paragraph 22.11 as follows:

2.4. in the Resolution of the Council of Ministers of the Republic of Belarus dated December 27, 2012, No. 1219 "On some issues of the state social order" (National Legal Internet Portal of the Republic of Belarus, 12.01.2013, 5/36764):
2.4.1. the title after the word "order" shall be supplemented with the words "in the field of social services";
2.4.2. in the first part of paragraph 1, the words ", sectoral and regional" shall be deleted;
2.4.3. in paragraph 2, the fourth and fifth subparagraphs shall be deleted;
2.4.4. the Resolution shall be supplemented with paragraph 21 of the following content:
"21. To establish:
a standard form of agreement for the performance of a state social order financed by providing subsidies to non-governmental non-profit organizations for the provision of social services in accordance with Annex 1;
a standard form of agreement for the performance of a state social order financed by providing subsidies to non-governmental non-profit organizations for the implementation of social projects in accordance with Annex 2.";
2.4.5. paragraph 4 shall be deleted;
2.4.6. in the Regulations on the Procedure for Conducting a Competition for the Performance of a State Social Order Financed by Providing Subsidies to Non-Governmental Non-Profit Organizations for the Provision of Social Services and the Implementation of Social Projects, approved by this Resolution:
paragraph 5 shall be supplemented with a seventh subparagraph of the following content:
"whose activities have been suspended.";
in paragraph 6:
the first part shall be set forth as follows:
"6. The announcement of a competition for the performance of a state social order financed by providing subsidies to non-governmental non-profit organizations for the provision of social services or the implementation of social projects, in the form according to Annex 1 or Annex 11 (hereinafter – competition announcement) shall be publicly available on the official website of the state customer on the global computer network Internet (hereinafter – official website of the state customer).";
in the second part:
after the word "placement", the words "and number" shall be added;
after the word "website", the words "of the state customer" shall be added;
the third part after the word "customer" shall be supplemented with the words ", with the exception of the circumstances specified in the second part of paragraph 22 of these Regulations";
in paragraph 15, the words "of the competition participant in the form according to Annex 4" shall be replaced with the words "for the provision of social services or the implementation of a social project through a state social order in the form according to Annex 4 or Annex 41";
the Regulations shall be supplemented with paragraph 181 of the following content:
"181. If a competitive proposal is submitted by only one participant or only one participant is admitted to participate in the competition (hereinafter – the sole participant of the competition), the competition commission shall consider the competitive proposal of this participant and issue a conclusion on the compliance or non-compliance of this competitive proposal with the terms of the competition. If the competitive proposal of the sole participant of the competition complies with the terms of the competition, an agreement for the performance of a state social order financed by providing subsidies to non-governmental non-profit organizations for the provision of social services or the implementation of social projects shall be concluded with him on the terms proposed by him.";
paragraph 19 shall be supplemented with the words ", to other competition participants – a written notification of the competition results";
paragraph 20 shall be set forth as follows:
"20. The competition shall be declared invalid in the cases provided for in the fifth part of Article 22 of the Law of the Republic of Belarus "On Social Services".";
paragraph 22 shall be set forth as follows:
"22. A repeat competition may be held in the cases provided for in the sixth part of Article 22 of the Law of the Republic of Belarus "On Social Services".
When the tender is re-held, the deadline for submitting tender proposals must be at least 15 calendar days from the date of publication of the tender notice on the official website of the state customer.”;
Appendices 1 and 4 to this Regulation shall be set forth in a new version (attached);
Supplement the Regulation with Appendices 11 and 41 (attached);
2.4.7. in the Regulation on the terms and procedure for granting subsidies to non-governmental non-profit organizations for the provision of social services and the implementation of social projects, approved by this resolution:
the second paragraph of clause 2 shall be supplemented with the words “, or for the payment of remuneration under civil law contracts for the provision of social services concluded by non-governmental non-profit organizations with individuals”;
clause 3 shall be set forth as follows:
“3. When granting subsidies for reimbursement of salary expenses, expenses determined in accordance with the established by law conditions for remuneration of employees of budgetary organizations and other organizations receiving subsidies, whose employees are equated in terms of remuneration to employees of budgetary organizations, as well as expenses for payment of labor leave and material assistance to employees providing social services, are taken into account.
Expenses for the payment of remuneration under civil law contracts are financed in an amount not exceeding the current nominal accrued average monthly salary for the activity “Care activities in specialized institutions and provision of social services”.
The amounts of statutory accruals for salaries and remuneration under civil law contracts are determined based on the expenses specified in the first and second parts of this clause.”;
the third and fourth paragraphs of clause 7 after the word “reporting” shall be supplemented with the words “on the use of the granted subsidy”;
clause 8 shall be set forth as follows:
“8. The transfer of subsidies is carried out taking into account the expenses of a non-governmental non-profit organization – the executor of the state social order in the manner determined by budget legislation.”;
2.5. in the list of social services provided by non-governmental non-profit organizations in the form of inpatient social services, by state organizations (their structural subdivisions), the turnover from the sale of which on the territory of the Republic of Belarus is exempt from value added tax, approved by the Resolution of the Council of Ministers of the Republic of Belarus dated February 19, 2013 No. 117 (National Legal Internet Portal of the Republic of Belarus, 22.02.2013, 5/36914; 02.07.2014, 5/39045; 13.03.2015, 5/40231):
2.5.1. clause 2 shall be supplemented with sub-clause 2.41 of the following content:
“2.41. delivery (provision) of medicines and medical devices;”;
2.5.2. clause 3 shall be excluded;
2.5.3. clause 5 shall be supplemented with sub-clause 5.81 of the following content:
“5.81. assistance in organizing medical care;”;
2.5.4. clause 6 shall be supplemented with sub-clauses 6.11–6.14 of the following content:
“6.11. provision of first aid;
6.12. assistance in fulfilling the instructions and recommendations of a medical worker;
6.13. provision of swimming pool, sauna, gym services;
6.14. organization of therapeutic and labor activities (in therapeutic and labor workshops, interest groups, subsidiary farms, etc.);”;
2.5.5. clause 8 shall be set forth as follows:
“8. Hourly child care services (nanny services).”
3. To recommend to the regional and Minsk City Councils of Deputies to provide for the allocation of funds for the implementation of this Resolution when forming local budgets for the next financial year.
4. The Ministry of Labor and Social Protection shall bring its regulatory legal acts into compliance with this Resolution and clarify issues of its application.
5. Regional executive committees and the Minsk City Executive Committee shall take measures to implement this Resolution.
6. This Resolution shall enter into force in the following order:
paragraphs 1 and 2 – from December 25, 2017;
paragraphs 3–5 – after its official publication.

REGULATION
on social services in a foster family
1. This Regulation governs the procedure and conditions for providing social services to adult incapacitated citizens in accordance with the list of social services provided in the form of social services in a foster family, as per Annex 1.
2. For the purposes of this Regulation, the following terms and their definitions are used:
foster family budget – the sum of funds intended for the financial support of the needs of a foster family;
agreement for the provision of social services in the form of social services in a foster family – an agreement concluded between the territorial center for social services for the population (hereinafter – territorial center) on behalf of the local executive and administrative body, an adult incapacitated citizen and another individual, providing for the provision of social services in the form of social services in a foster family (hereinafter – social services agreement);
foster family – a form of arrangement for an adult incapacitated citizen in conditions of cohabitation and joint housekeeping with another individual;
adult incapacitated citizen – a non-working disabled person of group I or II, a non-working citizen who has reached the age of 70, permanently residing in the territory of the Republic of Belarus:
who does not have minor children, as well as adult children, spouses and parents who are not disabled persons of group I or II, who have not reached the age entitling them to an old-age pension on general grounds;
who is not cared for by a person receiving a care allowance for a disabled person of group I or a person who has reached the age of 80;
who has not concluded a life annuity agreement or a lifelong maintenance agreement with dependency;
an individual providing social services in the form of social services in a foster family – a legally capable citizen aged 18 to 65, permanently residing in the territory of the Republic of Belarus, who is not a disabled person of group I or II and a person legally obliged to support an adult incapacitated citizen (hereinafter – assistant).
Other terms and their definitions are used in the meanings established by the Law of the Republic of Belarus "On Social Services".
3. Local executive and administrative bodies of the basic level make a decision on concluding a social services agreement taking into account the proposals of the commission created by them to consider issues of social services based on a social services agreement (hereinafter – commission).
The commission includes representatives of structural subdivisions of the local executive and administrative body, as well as representatives of other interested organizations (with their consent).
The commission submits proposals to the local executive and administrative body regarding the advisability of concluding a social services agreement and establishing a monthly monetary remuneration from the local budget for the assistant in case they provide social services to a Group I disabled person with a severely impaired ability to self-care.
4. The period for the local executive and administrative body to make a decision on concluding a social services agreement shall not exceed 60 days from the date of receipt of the documents provided for in paragraphs 11 and 12 of this Regulation.
5. Social services based on a social services agreement are provided if an adult incapacitated citizen has medical indications provided for in sub-paragraph 8.1 of paragraph 8 of the list of medical indications and medical contraindications for the provision of social services in social service institutions, established by Resolution No. 3/4 of the Ministry of Labor and Social Protection of the Republic of Belarus and the Ministry of Health of the Republic of Belarus dated January 10, 2013.
Social services agreements are not concluded with adult incapacitated citizens who, as of the date of application, have medical contraindications provided for in paragraph 1 and sub-paragraph 8.2 of paragraph 8 of the list of medical indications and medical contraindications for the provision of social services in social service institutions.
6. A social services agreement in the form of social services in a substitute family is concluded in the form according to Appendix 2.
The social services agreement, in addition to the conditions defined by law, must contain essential conditions:
on the place of joint residence, when determining which an adult incapacitated citizen (including a married couple) must be provided with accommodation in a separate living room;
on the procedure for forming the budget of the substitute family and its expenditure. The amount of funds transferred by an adult incapacitated citizen to the budget of the substitute family cannot exceed 75 percent of their assigned pension, including allowances, surcharges, and increases;
on the term of social services, which must not be less than 6 months;
on the amount of monthly monetary remuneration to the assistant if it is established by the local executive and administrative body. When providing social services to one adult incapacitated citizen, the assistant is set a monthly monetary remuneration of 100 percent of the largest subsistence minimum per capita, approved by the Ministry of Labor and Social Protection, for the last two quarters, and when simultaneously providing social services to two adult incapacitated citizens - 150 percent;
on the procedure for terminating the social services agreement.
7. The termination of a social services agreement is carried out in the cases and in the manner provided for by legislative acts.
Additional grounds for its termination by unilateral refusal to perform it are:
the fact that an adult incapacitated citizen, and (or) an assistant, and (or) family members living with them are in a state of alcoholic intoxication or in a state caused by the consumption of narcotic drugs, psychotropic substances, their analogues, toxic or other intoxicating substances;
the behavior of an adult incapacitated citizen that violates generally accepted norms and rules of conduct, humiliates the honor and dignity of the assistant and/or his family members living with him, and is not a consequence of his existing illness;
the presence of a mental disorder (illness) in an adult incapacitated citizen, and/or an assistant, and/or his family members living with him, requiring psychiatric care in inpatient settings;
the conclusion of a life annuity contract or a lifelong maintenance contract with an adult incapacitated citizen by the assistant or adult family members living with him;
the conclusion of a life annuity contract or a lifelong maintenance contract with another individual or legal entity by an adult incapacitated citizen;
the conclusion of a social services agreement by an adult incapacitated citizen and/or an assistant with a state social service institution in the forms of inpatient social services or home social services;
the assistant having an illness requiring medical care in inpatient settings.
In the event of circumstances that are grounds for termination or cancellation of the agreement, the payment of remuneration shall cease from the first day of the month following the month in which the circumstances arose.
8. When concluding a social services agreement with several adult incapacitated citizens (including a married couple), the agreement is concluded with each citizen separately.
It is not permitted for an assistant to conclude a social services agreement with three or more adult incapacitated citizens simultaneously.
9. A social services agreement is not concluded in the following cases:
absence of written consent from all adult family members living with the assistant for cohabitation with an adult incapacitated citizen, if the assistant's place of residence is chosen as the place of cohabitation;
conclusion of a social services agreement by an adult incapacitated citizen and/or an assistant with a state social service institution in the forms of inpatient social services or home social services;
the assistant and/or his family members living with him having illnesses provided for in the list of illnesses, in the presence of which persons cannot be guardians and trustees, established by Resolution No. 108 of the Ministry of Health of the Republic of Belarus dated December 15, 2017;
the adult incapacitated citizen, and/or the assistant, and/or his family members living with him having an unexpunged or unspent criminal record, an indictment for committing a crime (until the issue of guilt is resolved in the prescribed manner), their involvement within 12 months preceding the date of application in administrative liability for committing an administrative offense against human health, honor and dignity, public order and morality.
10. Monitoring of social services in the form of social services in a foster family is carried out by the territorial center after the conclusion of the agreement:
in the first three months - at least once every two weeks;
in the subsequent three months - at least once a month;
after the first six months - at least once a quarter.
11. To conclude a social service agreement, the assistant applies to the territorial center at the place of registration (residence) with an application in the form according to Appendix 3 and submits the following documents:
identity document;
information on income for the month preceding the month of application – if available;
a medical certificate of health status, containing information on the absence of diseases provided for in the list of diseases, in the presence of which persons cannot be guardians and trustees – for themselves and each adult family member living with them.
Within three working days from the date of application, the territorial center conducts an examination of the assistant's living conditions, drawing up an act of examination of the citizen's living conditions in the form according to Appendix 4 (hereinafter – the examination act) and requests from state bodies (organizations):
a certificate of the assistant's place of residence and family composition;
information on the absence (presence) of criminal prosecution (conviction), administrative offenses in the territory of the Republic of Belarus – for the assistant and each adult family member living with them;
information on the amount of pension received for the month preceding the month of application – for pension recipients;
other necessary documents.
When submitting the application, the assistant has the right to personally submit the documents that, in accordance with the second part of this paragraph, are requested by the territorial center.
12. To conclude a social service agreement, an adult incapacitated citizen applies to the territorial center at the place of residence with an application in the form according to Appendix 5 and submits the following documents:
identity document;
disability certificate – for citizens belonging to this category;
a medical certificate of health status, containing information on the presence of medical indications and (or) the absence of medical contraindications in accordance with paragraph 1, subparagraphs 8.1 and 8.2 of paragraph 8 of the list of medical indications and medical contraindications for the provision of social services in social service institutions.
Within three working days from the date of application, the territorial center conducts an examination of the adult incapacitated citizen's living conditions, drawing up an examination act and requests from state bodies (organizations):
a certificate of the citizen's place of residence and family composition;
information on the absence (presence) of criminal prosecution (conviction), administrative offenses in the territory of the Republic of Belarus;
information on the absence of care for him by a person receiving an allowance for caring for a Group I disabled person or a person who has reached the age of 80;
information on the amount of pension received by him for the month preceding the month of application;
other necessary documents.
When submitting the application, an adult incapacitated citizen has the right to personally submit the documents that, in accordance with the second part of this paragraph, are requested by the territorial center.
13. When accepting an application, the territorial center explains to the adult incapacitated citizen and the assistant the procedure for providing social services in the form of social care in a foster family.
14. The territorial center, as part of its work to create a foster family:
organizes meetings to introduce the assistant and the adult incapacitated citizen;
conducts socio-psychological diagnostics to determine the psychological compatibility of the assistant and the adult incapacitated citizen;
organizes the training and preparation of the assistant.
15. With the consent of the assistant and the adult incapacitated citizen to conclude a social services agreement, the territorial center, no later than 40 days from the date of submission of the documents provided for in paragraphs 11 and 12 of this Regulation, sends these documents to the local executive and administrative body for consideration by the commission and decision-making by the local executive and administrative body.
The adult incapacitated citizen and the assistant are informed in writing by the territorial center of the decision taken no later than three working days after the decision is made by the local executive and administrative body.

LIST
of social services provided in the form of social services in a foster family
1. Consulting and information services:
assistance in requesting necessary documents to exercise the right to social support and social services;
assistance in preparing necessary documents to exercise the right to social support and social services.
2. Social and household services:
payment for housing and communal services, use of premises, communication services, other payments (payment for goods, services, taxes, fines, loan repayments);
delivery (provision) of medicines and medical devices;
assistance in performing (performing) sanitary and hygienic procedures;
assistance in dressing, undressing, changing clothes, changing underwear;
assistance in eating (feeding);
assistance in changing (re-making) bed linen;
organizing outdoor walks;
organizing rational nutrition, including dietary nutrition as prescribed by a doctor;
purchase and home delivery of food products, as well as essential industrial goods;
stoking stoves;

assistance in restoring and maintaining family ties;

assistance in organizing medical care;
assistance in obtaining benefits and material assistance provided by law;
assistance in obtaining legal services;
assistance in organizing (organizing) funeral services;
accompaniment to state healthcare organizations;
assistance in observing property rights;
assistance in examination (re-examination) for the purpose of establishing (changing) a disability group.
5. Social rehabilitation services:
training in the use of technical means of social rehabilitation;
first aid;
assistance in fulfilling the prescriptions and recommendations of a medical professional;
organizing the repair of faulty technical means of social rehabilitation or assisting in their replacement;
assistance in providing technical means of social rehabilitation included in the State Register (list) of technical means of social rehabilitation, approved by Resolution of the Council of Ministers of the Republic of Belarus dated December 11, 2007 No. 1722;
assistance in implementing rehabilitation measures of the individual rehabilitation program for disabled persons.

2. Rights and Obligations of the Parties
2.1. An incapacitated citizen has the right to:
receive social services in the form of social care in a foster family in accordance with this agreement;
respectful and humane treatment from the assistant, their family members living with them, and the customer's employees;
high-quality provision of social services;
confidentiality of personal information;
participate in the formation and expenditure of the foster family's budget;
receive information about the size and purpose of the foster family's budget expenditure;
free use of the assistant's property provided for common use;
receive a complex of consulting and informational, socio-psychological, socio-pedagogical, and other services from the customer to ensure the stable functioning of the foster family;
protection of their rights and legitimate interests, including in court;
submit proposals for amending the terms of this agreement;
inform the customer about the assistant's improper performance of obligations under this agreement;
refuse to receive social services;
other rights in accordance with legislation.
2.2. An incapacitated citizen is obliged to:
treat the assistant, their family members living with them, and the customer's employees with respect;
treat the assistant's property with care;
not impede the provision of social services;
contribute to maintaining a favorable psychological climate in the foster family;
monthly transfer funds to the foster family's budget in the amount determined by the agreement on the formation and expenditure of the foster family's budget;
notify the parties of the intention to terminate this agreement at least two weeks before the proposed termination date;
fulfill other obligations in accordance with legislation.
2.3. The assistant has the right to:
be treated with respect by the incapacitated citizen and the customer's employees;
have their property treated with care by the incapacitated citizen;
receive monetary remuneration from local budget funds in case of providing social services to a Group I disabled person with a severely impaired ability to self-care;
free use of the incapacitated citizen's property provided for common use;
receive a complex of consulting and informational, socio-psychological, socio-pedagogical, and other services from the customer to ensure the stable functioning of the foster family;
participate in the formation and expenditure of the foster family's budget;
submit proposals for amending the terms of this agreement;
other rights in accordance with legislation.
2.4. The assistant is obliged to:
treat the incapacitated citizen and the customer's employees with respect;
provide social services to the incapacitated citizen in accordance with this agreement;
monthly transfer funds to the foster family's budget in the amount determined by the agreement on the procedure for forming and expending the foster family's budget;
treat the incapacitated citizen's property with care;
ensure proper housing and living conditions for the incapacitated citizen;
contribute to creating a favorable psychological climate in the foster family;
ensure respectful treatment of the incapacitated citizen by their family members living with them;
contribute to the preservation of the incapacitated citizen's property;
ensure the confidentiality of personal information of the incapacitated citizen;
notify the customer of the impossibility of further performance of obligations under the contract at least two weeks before the occurrence of circumstances that make their performance impossible;
perform other obligations in accordance with the law.
2.5. The Customer has the right to:
receive reliable information about the psychological climate in the foster family, the types, scope and quality of social services provided by the assistant and the incapacitated citizen, and the fulfillment of other terms of this agreement by both parties;
make proposals for the termination of this agreement due to non-fulfillment of the terms of this agreement by the assistant and (or) the incapacitated citizen;
other rights in accordance with the law.
2.6. The Customer is obliged to:
provide the assistant and the incapacitated citizen with a complex of consulting and information, socio-psychological, socio-pedagogical and other services to ensure the stable functioning of the foster family;
ensure the payment of a monthly monetary remuneration to the assistant on the basis of a decision of the local executive and administrative body;
pay mandatory insurance contributions for the assistant in the prescribed manner to the budget of the state extra-budgetary fund of social protection of the population of the Republic of Belarus and to the Belarusian Republican Unitary Insurance Enterprise "Belgosstrakh";
monitor the social services provided to the incapacitated citizen in the foster family;
notify the parties of the registration of the received notification (application) of unilateral refusal to perform this agreement;
consider the possibility of organizing further social services for the incapacitated citizen by state social service institutions in case of termination of this agreement.
3. Validity of this Agreement and the Procedure for its Termination
3.1. This Agreement enters into force from the moment of its signing by the parties and remains in effect until the full fulfillment of obligations under this Agreement.
3.2. The terms of this Agreement may be amended by concluding an additional agreement to the Agreement.
3.3. This Agreement shall be terminated:
by agreement of the parties;
in other cases provided for by law.
In case of termination of this Agreement by unilateral refusal to perform it, the date of its termination shall be the date specified in the notification (application) of either party, registered by the customer.
4. Final Provisions
4.1. This Agreement is drawn up in 3 copies, all having equal legal force.
4.2. The parties will strive to resolve all possible disputes and disagreements that may arise under or in connection with the Agreement through negotiations.
Disputes not settled through negotiations shall be submitted to the court for consideration in the manner prescribed by current legislation.
5. Liability of the Parties
5.1. The parties are responsible for the performance of obligations under this Agreement and for the violation of the terms of this Agreement in accordance with the law.
5.2. In all matters not provided for by this Agreement, the parties shall be guided by the law.

Liability of the Parties

Force Majeure
8. The Parties shall be released from liability for partial or full non-performance of obligations under this Agreement if such non-performance resulted from force majeure circumstances.
Force majeure circumstances shall mean events that arose after the conclusion of this Agreement and are beyond the control of its parties (fires, earthquakes, floods, hurricanes and other natural disasters, epidemics, epizootics, accidents, military actions, mass riots), as well as other circumstances that will be recognized as force majeure circumstances in the manner established by law.
Amendment and Termination of this Agreement
9. Amendment and termination of this Agreement shall be carried out on the grounds provided for by civil legislation.
10. Additional grounds for termination of this Agreement, in addition to those established by civil legislation, are:
cessation of funding for the executor of the state social order;
the presence of two or more substantiated complaints from recipients of social services (their legal representatives) about the non-fulfillment by the executor of the state social order of the terms of the agreement on the provision of social services concluded between the executor of the state social order and citizens (their legal representatives);
violation by the executor of the state social order of the norms and requirements of regulatory legal acts and technical regulatory legal acts on social services.
11. Amendment and termination of this Agreement shall be made in writing by concluding an additional agreement thereto.
Final Provisions
12. This Agreement is concluded for a period of ___________________________________

6. The State Social Order Executor shall:

6.3. provide the state customer with information on the implementation of the social project and the use of the provided subsidy within the following terms:

Liability of the Parties
7. The Parties shall be liable for non-performance or improper performance of obligations under this agreement in accordance with the legislation of the Republic of Belarus.
Force Majeure
8. The Parties shall be released from liability for partial or complete non-performance of obligations under this agreement if such non-performance was a consequence of force majeure circumstances.
Circumstances of force majeure refer to events that occurred after the conclusion of this agreement and are beyond the control of its parties (fires, earthquakes, floods, hurricanes and other natural disasters, epidemics, epizootics, accidents, military actions, mass riots), as well as other circumstances that will be recognized as force majeure in the manner prescribed by law.
Amendment and Termination of this Agreement
9. The amendment and termination of this agreement shall be carried out on the grounds provided for by civil legislation.
10. Additional grounds for the termination of this agreement, in addition to those established by civil legislation, are:
cessation of funding for the executor of the state social order;
the presence of two or more substantiated complaints from recipients of social services (their legal representatives) regarding the failure of the executor of the state social order to fulfill the terms of the agreement on the provision of social services concluded between the executor of the state social order and citizens (their legal representatives);
violation by the executor of the state social order of the norms and requirements of regulatory legal acts and technical regulatory legal acts on social services.
11. The amendment and termination of this agreement shall be made in writing by concluding an additional agreement thereto.
Final Provisions
12. This agreement is concluded for a period of ___________________________________

13. This agreement is drawn up in two copies, having equal legal force, one of which is held by the executor of the state social order, the other by the state customer.
