Based on sub-paragraph five of paragraph 2 of the Resolution of the Council of Ministers of the Republic of Belarus of December 27, 2012 № 1218 "On certain issues of providing social services" and sub-paragraph one of sub-paragraph 7.1 of paragraph 7 of the Regulations on the Ministry of Labor and Social Protection of the Republic of Belarus, approved by the Resolution of the Council of Ministers of the Republic of Belarus of October 31, 2001 № 1589, the Ministry of Labor and Social Protection of the Republic of Belarus RESOLVES:
1. To approve the Instruction on the procedure and conditions for the provision of social services by state social service institutions (attached).
2. To establish:
the form of the gratuitous social services agreement by state organizations providing social services, according to Appendix 1;
the form of the paid social services agreement by state organizations providing social services, according to Appendix 2;
the form of the paid social services agreement by state organizations providing social services (trilateral), according to Appendix 3.
3. This Resolution shall enter into force after its official publication.

2. Rights and Obligations of the Parties
2.1. The citizen has the right to:
receive social services in accordance with this agreement;
respectful and humane treatment from employees providing social services;
high-quality provision of social services;
refuse to receive social services;
confidentiality of information that became known during the provision of social services to the employee providing social services, as well as about the fact of applying for social services;
protection of their rights and legitimate interests, including in court;
other rights in accordance with legislation.
2.2. The citizen (legal representative*) is obliged to:
provide complete and reliable information to the Contractor necessary for the provision of social services;
not impede the provision of social services;
comply with the internal regulations of the Contractor;
timely inform the Contractor about circumstances leading to a change in the conditions, procedure or termination of social services;
treat the Contractor's employees with respect;
take measures to independently overcome a difficult life situation;
treat with care the property transferred to him for temporary use;
perform other duties in accordance with the legislation.
2.3. The Contractor undertakes to:
provide the citizen with social services stipulated by this agreement;
notify the citizen (legal representative*) of changes in the conditions for the provision of social services.
2.4. The Contractor has the right to:
receive from the citizen (legal representative*) all information necessary for the provision of social services;
not to commence the provision of social services or part of the services in case of non-fulfillment by the citizen (legal representative*) of the obligations stipulated by this agreement;
replace the employee providing social services.
3. Term of the Agreement and Procedure for its Termination
3.1. This agreement enters into force upon its signing by the parties and remains valid until the full fulfillment of obligations under the agreement.
3.2. The terms of the agreement may be amended by concluding an additional agreement to the agreement.
3.3. This agreement shall be terminated:
by agreement of the parties;
in other cases provided for by law.
Unilateral refusal to perform the agreement is allowed in cases:
provided for by paragraphs two to five of part five, part six of Article 31 of the Law of the Republic of Belarus of May 22, 2000, No. 395-Z "On Social Services";
non-fulfillment by the other party of the obligations stipulated by this agreement.
The agreement shall be terminated from the date specified in the written notice (statement) of unilateral refusal to perform the agreement.
4. Final Provisions
4.1. This agreement is drawn up in ____ copies, all having equal legal force.
4.2. Disputes and disagreements between the parties shall be resolved in court in accordance with the legislation.

quality provision of social services;
refuse to receive social services;

protection of their rights and legitimate interests, including in court;
other rights in accordance with legislation.
2.2. The Citizen (legal representative*) is obliged to:
provide full and accurate information to the Contractor necessary for the provision of social services;
not hinder the provision of social services;
comply with the internal regulations of the Contractor;
timely inform the Contractor about circumstances entailing a change in the conditions, procedure, or termination of social services;
treat the Contractor's employees with respect;
take measures to independently overcome difficult life situations;
handle property transferred for temporary use with care;
to fully and timely pay for social services;
to perform other duties in accordance with the legislation.
2.3. The Contractor undertakes:
to provide social services stipulated by this agreement;
to notify the citizen (legal representative*) of changes in the conditions for the provision of social services.
2.4. The Contractor has the right:
to receive from the citizen (legal representative*) all information necessary for the provision of social services;
not to commence the provision of social services or part of the services if the citizen (legal representative*) fails to fulfill the obligations stipulated by this agreement;
to replace the employee providing social services.
3. Term of the Agreement and Procedure for its Termination
3.1. This agreement enters into force upon its signing by the parties and remains valid until the full fulfillment of obligations under the agreement.
3.2. The terms of the agreement may be amended by concluding an additional agreement to the agreement.
3.3. This agreement shall be terminated:
by agreement of the parties;
in other cases provided for by law.
Unilateral refusal to perform the agreement is allowed in cases:

non-payment for social services in full for two consecutive months;

fully and timely pay for the provision of social services if there are obligations to pay for the provision of social services;
fulfill other obligations in accordance with the legislation.
2.3. The Contractor undertakes to:
provide social services stipulated by this agreement;
provide the Payer with the information necessary for paying for social services;
notify the citizen (legal representative*) and the Payer about changes in the cost and conditions of social services provision.
2.4. The Contractor has the right to:
receive from the citizen (legal representative*) and the Payer all information necessary for the provision of social services;
not to start providing social services or part of the services in case of non-fulfillment by the citizen (legal representative*) and the Payer of the obligations stipulated by this agreement;
replace the employee providing social services.
2.5. The Payer undertakes to pay for the provision of social services in the manner and within the terms established in sub-paragraph 1.2 of this agreement.
2.6. The Payer has the right to:
receive from the Contractor all information necessary for paying for social services;
not to start paying for social services in case of non-fulfillment by the Contractor of the obligations stipulated by this agreement.
3. Validity of the agreement and procedure for its termination
3.1. This agreement comes into force from the moment of its signing by the parties and is valid until the full fulfillment of obligations under the agreement.
3.2. The terms of the agreement may be changed by concluding an additional agreement to the agreement.
3.3. This agreement shall be terminated:
by agreement of the parties;
in other cases provided for by law.
Unilateral termination of the agreement is permitted in cases:
provided for in paragraphs two to five of part five, part six of Article 31 of the Law of the Republic of Belarus of May 22, 2000, No. 395-Z "On Social Services";
failure by the Payer to pay for social services in full for two consecutive months;
non-performance by other parties of the obligations provided for by this agreement.
The agreement shall be terminated from the date specified in the written notice (statement) of unilateral termination of the agreement.

INSTRUCTION
on the procedure and conditions for providing social services by state social service institutions
CHAPTER 1
GENERAL PROVISIONS
1. This Instruction regulates the procedure and conditions for the provision of social services stipulated in the list of free and publicly available social services of state social service institutions with norms and standards for the provision of these services to citizens, approved by Resolution of the Council of Ministers of the Republic of Belarus dated December 27, 2012, No. 1218 (hereinafter – the list), by state social service institutions providing inpatient social services: residential care homes for the elderly and disabled, residential care homes for disabled children with psychophysical developmental peculiarities, special homes for veterans, the elderly and disabled (hereinafter, unless otherwise provided, – inpatient social service institutions), territorial centers for social services for the population (hereinafter – territorial centers), family and child social service centers (family and child social assistance) (hereinafter – family and child centers), centers for social rehabilitation and habilitation of disabled persons (hereinafter, unless otherwise provided, – rehabilitation center).
2. For the purposes of this Instruction, the following terms and their definitions apply:
citizen affected by domestic violence – a citizen who has stated that they have suffered physical and/or psychological harm as a result of domestic violence;
low-income citizens (families) – citizens (families) who, for objective reasons, have an average per capita income below the subsistence minimum budget per capita, effective on the date of application for social services;
non-working citizens – citizens who are not individual entrepreneurs, do not engage in labor activities based on labor, civil law contracts, the subject of which is the performance of work, provision of services, and creation of intellectual property;
incapacitated citizen – a disabled child under 18 years of age who has completed the content of the educational program of special education at the level of general secondary education for persons with intellectual disabilities, as confirmed by a certificate of special education; a disabled person of group I or II; a non-working citizen aged 60 and older, who has reached the generally established retirement age and is entitled to a state pension;
incapacitated family – cohabiting incapacitated citizens who are bound by moral and material commonality and support, shared household, rights and obligations arising from marriage, close kinship, adoption;
single incapacitated citizen – an incapacitated citizen who has no adult children, spouses, or parents who are not disabled persons of group I or II, have not reached the generally established retirement age (hereinafter – relatives legally obliged to support them), or other natural or legal persons with whom a life annuity contract with provision of maintenance, or a lifelong maintenance contract with dependency has been concluded.
Other terms and their definitions are used in the meanings established by the Law of the Republic of Belarus dated May 22, 2000, No. 395-Z "On Social Services".
3. Social services are provided to citizens in difficult life situations due to circumstances specified in part two of Article 28 of the Law of the Republic of Belarus "On Social Services".
4. Social services are provided by state social service institutions based on an oral or written application in the form according to Appendix 1 and the following social service agreements (hereinafter, unless otherwise provided, – social service agreement), concluded between:
by a citizen (his legal representative), on the one hand, and a state organization providing social services, on the other hand:
an agreement for the gratuitous provision of social services by state organizations providing social services, in the form according to Annex 1 to the resolution approving these Instructions, – in case of gratuitous provision of social services;
an agreement for the paid provision of social services by state organizations providing social services, in the form according to Annex 2 to the resolution approving these Instructions, – in case of paid provision of social services;
by a citizen (his legal representative), on the one hand, a state organization providing social services, on the other hand, and a legal entity or individual, including an individual entrepreneur, concluding an agreement in the interests of the citizen, on the third hand:
an agreement for the paid provision of social services by state organizations providing social services (trilateral), in the form according to Annex 3 to the resolution approving these Instructions, – in case of paid provision of social services and payment for their provision by a legal entity or individual, including an individual entrepreneur.
The conclusion, amendment of terms, and termination of a social services agreement are carried out in accordance with the legislation.
Social services provided without a social services agreement include those specified in:
paragraphs 1–7 of the list, – to citizens who, in accordance with the legislation, are provided with special residential premises of the state housing stock in psycho-neurological boarding homes (departments) for the elderly and disabled free of charge;
paragraphs 1–7, 9–11 of the list, – to orphans and children left without parental care, who, in accordance with the legislation, are provided with special residential premises of the state housing stock in boarding homes for disabled children with psycho-physical developmental peculiarities free of charge;
paragraphs 16 and 27 of the list, – in the forms of non-stationary and urgent social services;
subparagraph 19.3.5 of paragraph 19, subparagraph 22.7 of paragraph 22, subparagraphs 29.3.1 and 29.3.4 of paragraph 29 of the list, – to citizens in difficult life situations, in the form of non-stationary social services.
5. Payment for social services under a social services agreement is made by the citizen with whom the social services agreement is concluded (his legal representative), or by another legal entity or individual, including an individual entrepreneur, in accordance with the legislation.
6. Upon receipt of an application, the citizen (his legal representative) is informed about the procedure and conditions for providing social services.
7. Social services are provided to citizens on a gratuitous and paid basis.
On a paid basis, social services within the established norms and standards of provision of citizens with these services (hereinafter – norms and standards) are provided at tariffs for social services included in the list, established in accordance with the legislation.
Certain incapacitated citizens, who, in accordance with these Instructions, should receive social services on a paid basis, may, as an exception, by decision of local executive and administrative bodies in accordance with Article 6 of the Law of the Republic of Belarus of January 4, 2010, No. 108-Z "On Local Government and Self-Government in the Republic of Belarus", receive social services within the established norms and standards free of charge or on terms of partial payment.
If necessary, families raising children may, as an exception, by decision of local executive and administrative bodies in accordance with Article 6 of the Law of the Republic of Belarus "On Local Government and Self-Government in the Republic of Belarus", receive social services within the established norms and standards free of charge or on terms of partial payment.
8. The list of medical indications and medical contraindications for the provision of social services in social service institutions is determined in accordance with the legislation.
The presence of medical indications and/or the absence of medical contraindications for the provision of social services is confirmed by a medical certificate of the health status of the citizen applying for social services, or by the conclusion of the medical advisory commission of a state healthcare organization (hereinafter referred to as the MCC conclusion).
9. Citizens who are cared for by persons receiving a care allowance for a Group I disabled person or a person who has reached the age of 80, and citizens who have concluded annuity agreements with the provision of maintenance funds, as well as lifelong maintenance agreements with dependency, are entitled only to social services provided in the form of non-residential social services free of charge, with the exception of social services provided for in paragraphs 25 and 251 of the list.
Citizens who have concluded annuity agreements with the provision of maintenance funds, as well as lifelong maintenance agreements with dependency (with the exception of citizens who have concluded such agreements with local executive and administrative bodies), are entitled to social services in the form of residential social services provided by social service institutions, on terms of full payment for the cost of social services, calculated based on the tariffs for social services established by regional (Minsk city) executive committees.
Citizens who are cared for by persons receiving a care allowance for a Group I disabled person or a person who has reached the age of 80 are also entitled to social services provided in the form of semi-residential social services, and social services provided for in paragraph 13, subparagraphs 17.1, 17.6, 17.8, 17.23 of paragraph 17 of the list.
Families in which both parents – mother (stepmother), father (stepfather) – or a parent in a single-parent family are Group I or II disabled persons, and who are cared for by persons receiving a care allowance for a Group I disabled person or a person who has reached the age of 80, are entitled to social services provided for in subparagraph 23.5 of paragraph 23 and subparagraph 32.5 of paragraph 32 of the list.
91. When a citizen who has suffered from domestic violence applies, a questionnaire for identifying a victim of domestic violence and identifying their needs is filled out in the form according to Appendix 3.
CHAPTER 2
PROCEDURE AND CONDITIONS FOR THE PROVISION OF SOCIAL SERVICES BY RESIDENTIAL SOCIAL SERVICE INSTITUTIONS
10. Social services, with the exception of social services specified in the second and third paragraphs of part three of clause 4 of these Instructions, are provided by inpatient social service institutions in accordance with social service agreements in the forms set out in Appendices 1–3 to the resolution approving these Instructions, to citizens placed in an inpatient social service institution on the basis of a referral for settlement in the said institution or a special residential lease agreement from the state housing stock.
The specific list of social services provided to citizens, as stipulated in the second and third paragraphs of part three of clause 4 of these Instructions, is approved by the head of the psycho-neurological boarding house for the elderly and disabled and the boarding house for disabled children with psychophysical developmental peculiarities.
11. Inpatient social service institutions provide social services, as stipulated in clauses 1–11, 13 of the list, free of charge, within the established list of norms and standards for the provision of services to citizens by state social service institutions, to citizens who, in accordance with legislation, are provided with special residential premises from the state housing stock in inpatient social service institutions free of charge.
111. When boarding houses for disabled children with psychophysical developmental peculiarities provide care services for disabled children (social respite services), the services stipulated in clauses 1–3, subclauses 4.1.1, 4.1.7, 4.5 of clause 4, clause 5, subclauses 6.1, 6.3–6.6 of clause 6 of the list are provided free of charge, with the exception of the service stipulated in subclause 2.5 of clause 2 of the list, which is provided on a fee basis.
When inpatient social service institutions provide day care services, the social services stipulated in clause 1, subclauses 2.1–2.6, 2.7.1–2.7.4, 2.7.7–2.7.9, 2.8, 2.13 of clause 2, clause 3, subclauses 4.1.1, 4.1.7, 4.5 of clause 4, clause 5, subclauses 6.1, 6.3–6.6 of clause 6, clause 10 of the list are provided free of charge, with the exception of the service stipulated in subclause 2.5 of clause 2 of the list, which is provided on a fee basis.
To conclude a day care social service agreement with an inpatient social service institution, a citizen or their legal representative applies to the said social service institution and submits the following documents:
an application in the form according to Appendix 1;
an identity document of the citizen;
a document confirming the authority of the legal representative – in case of application by a legal representative;
a conclusion from the medical advisory board;
documents confirming the right to benefits;
an extract from medical records;
a medical certificate of health status, containing information about the absence of contact with infectious patients;
consent to the processing of special personal data in cases provided for by personal data legislation.
The decision to conclude a social service agreement is made by the head of the inpatient social service institution within 5 working days from the date of submission of the documents provided for in part three of this clause.
112. When disabled persons (disabled children) undergo a course of social rehabilitation and habilitation in inpatient social service institutions, they are provided with services stipulated in clauses 1–7 of the list, within the established norms and standards, free of charge.
Upon admission of a disabled person (disabled child) to a residential social service institution for a course of social rehabilitation and habilitation, an individual social rehabilitation and habilitation plan for the disabled person or disabled child is drawn up in the social rehabilitation and habilitation center (department) for disabled persons (hereinafter, unless otherwise provided, – individual rehabilitation plan) based on a comprehensive assessment of their needs, in the form according to Appendix 31, which includes a specific list of social services provided. The conclusion on the results of social rehabilitation and habilitation of a disabled person in the social rehabilitation and habilitation center (department) for disabled persons (hereinafter – rehabilitation results conclusion) and recommendations for further social rehabilitation and habilitation (re-taking a course of social rehabilitation and habilitation in a residential social service institution) are an integral part of the individual rehabilitation plan.
Upon completion of a course of social rehabilitation and habilitation for a disabled child, with the exception of disabled children specified in part four of this paragraph, a rehabilitation results conclusion and recommendations for re-taking a course of social rehabilitation and habilitation in a residential social service institution are issued.
Upon completion of a course of social rehabilitation and habilitation for a disabled person or disabled child under 18 years of age who has completed the content of an educational program of special education at the level of general secondary education for persons with intellectual disabilities, a rehabilitation results conclusion and recommendations for further social rehabilitation and habilitation in a territorial center at the place of registration (residence) and/or re-taking a course of social rehabilitation and habilitation in a residential social service institution are issued.
An extract from the individual rehabilitation plan, containing recommendations for further social rehabilitation and habilitation, is issued to the disabled person (legal representative of the disabled person (disabled child)), and with their consent, a second copy is sent within three working days from the date of completion of the social rehabilitation and habilitation course to the territorial center at the place of registration (residence) of the disabled person (disabled child).
12. Citizens for whom, in accordance with the legislation, special residential premises of the state housing stock in residential social service institutions are provided on a paid basis, social services are also provided on a paid basis, with the exception of services provided for in paragraph 1, subparagraphs 2.9 and 2.13 of paragraph 2, paragraph 3, subparagraphs 4.1.1–4.1.7, 4.2–4.4 of paragraph 4, paragraphs 5, 6, 8 of the list, provided free of charge.
In psycho-neurological boarding houses (departments) for the elderly and disabled, social services are provided to citizens on a paid basis under conditions of full and partial payment.
The amount of partial payment is:
for citizens whose pension does not exceed 100 percent of the subsistence minimum budget approved in the established manner on average per capita – 50 percent of the tariff for social services;
for citizens whose pension is above 100 percent of the subsistence minimum budget on average per capita, but does not exceed 150 percent – 70 percent of the tariff for social services;
for citizens whose pension is above 150 percent of the subsistence minimum budget on average per capita, but does not exceed 200 percent – 90 percent of the tariff for social services.
Social services are provided on a full payment basis (100 percent of the social services tariff) to citizens whose pension amount exceeds 200 percent of the subsistence minimum budget per capita on average, as well as to citizens specified in part two of paragraph 9 of this Instruction.
In neuropsychiatric residential care homes (departments) for the elderly and disabled with enhanced comfort, social services are provided to citizens on a full payment basis (100 percent of the social services tariff).
When determining the payment conditions for the provision of social services by neuropsychiatric residential care homes (departments) for the elderly and disabled, the citizen's pension amount and the subsistence minimum budget per capita on average, approved in the established manner as of the date of the social services agreement, are applied.
The amount of payment for social services is adjusted upon recalculation of pensions, changes in the subsistence minimum budget per capita on average, and tariffs for social services provided by neuropsychiatric residential care homes (departments) for the elderly and disabled.
13. Social services provided in stationary social service institutions on a paid basis are paid monthly in the manner established by the social services agreement, concluded in the form according to Appendix 2 or 3 to the resolution approving this Instruction.
CHAPTER 3
PROCEDURE AND CONDITIONS FOR THE PROVISION OF SOCIAL SERVICES BY TERRITORIAL CENTERS
14. Territorial centers provide social services in the form of stationary social services to incapacitated citizens, as stipulated in sub-paragraphs 16.1–16.3, 16.5 of paragraph 16, sub-paragraphs 17.7.1, 17.11–17.23 of paragraph 17, sub-paragraphs 19.1–19.4 of paragraph 19, sub-paragraphs 20.1–20.3, 20.5, 20.7, 20.8 of paragraph 20, and paragraphs 21 and 22 of the list.
Social services provided by territorial centers in the form of stationary social services to incapacitated citizens free of charge include those stipulated in sub-paragraphs 16.1–16.3, 16.5 of paragraph 16, and paragraph 21 of the list.
On a partial payment basis, territorial centers provide social services in the form of stationary social services to single incapacitated citizens, as stipulated in sub-paragraphs 17.7.1, 17.11–17.23 of paragraph 17, sub-paragraphs 19.1–19.4 of paragraph 19, sub-paragraphs 20.1–20.3, 20.5, 20.7, 20.8 of paragraph 20, and paragraph 22 of the list.
Partial payment is set at 85 percent of the citizen's average per capita income, calculated in accordance with paragraph 21 of this Instruction, but not more than 80 percent of the tariff for social services in the form of stationary social services.
On a full payment basis, territorial centers provide social services in the form of stationary social services to incapacitated citizens, excluding those specified in the third part of this paragraph, as stipulated in sub-paragraphs 17.7.1, 17.11–17.23 of paragraph 17, sub-paragraphs 19.1–19.4 of paragraph 19, sub-paragraphs 20.1–20.3, 20.5, 20.7, 20.8 of paragraph 20, and paragraph 22 of the list.
15. Territorial centers provide social services in the form of semi-stationary social services to incapacitated citizens, as stipulated in sub-paragraphs 16.1–16.3, 16.5 of paragraph 16, sub-paragraphs 17.13, 17.16, 17.17.1, 17.17.6, 17.17.7, 17.22, 17.24 of paragraph 17, sub-paragraphs 19.1–19.4 of paragraph 19, sub-paragraphs 20.1–20.4 of paragraph 20, and paragraphs 21 and 22 of the list.
Territorial centers provide the following free of charge in the form of semi-stationary social services:
to incapacitated citizens – social services provided for in sub-paragraphs 16.1–16.3, 16.5 of paragraph 16, sub-paragraphs 17.13, 17.16, 17.17.1, 17.17.6, 17.17.7, 17.22 of paragraph 17, sub-paragraphs 19.1, 19.3.1, 19.3.2, 19.3.4, 19.3.5, 19.4 of paragraph 19, sub-paragraphs 20.1–20.4 of paragraph 20, paragraphs 21 and 22 of the list;
to disabled persons of groups I and II, low-income single non-working citizens aged 60 and over who have reached the generally established retirement age and are entitled to a state pension, disabled children under 18 years of age who have completed the content of the special education curriculum at the level of general secondary education for persons with intellectual disabilities – social services provided for in sub-paragraphs 19.2 and 19.3.3 of paragraph 19 of the list.
On conditions of partial payment, territorial centers provide semi-residential social services to:
single non-working citizens aged 60 and over who have reached the generally established retirement age, are entitled to a state pension, and whose per capita income does not exceed 200 percent of the subsistence minimum budget approved in the established manner on average per capita – social services provided for in sub-paragraphs 19.2 and 19.3.3 of paragraph 19 of the list;
low-income single incapacitated citizens – social services provided for in sub-paragraph 17.24 of paragraph 17 of the list.
The amount of partial payment for a single citizen is 60 percent of the tariff for social services.
On conditions of full payment, territorial centers provide semi-residential social services to non-working citizens aged 60 and over who have reached the generally established retirement age, are entitled to a state pension, with the exception of citizens specified in the third paragraph of part two and part three of this paragraph – social services provided for in sub-paragraph 17.24 of paragraph 17, sub-paragraphs 19.2 and 19.3.3 of paragraph 19 of the list.
16. Territorial centers provide social services free of charge in the form of non-residential social services to citizens in difficult life situations, as provided for in paragraphs 16 and 18, sub-paragraphs 19.3.4, 19.3.5, 19.5 of paragraph 19, sub-paragraphs 20.1–20.3.1, 20.9 of paragraph 20, paragraph 21, sub-paragraphs 22.1–22.3, 22.5, 22.7 of paragraph 22, paragraphs 25 and 251 of the list.
17. Territorial centers provide social services at home to:
incapacitated citizens – social services provided for in sub-paragraphs 16.1–16.3, 16.5 of paragraph 16, sub-paragraphs 17.1–17.6, 17.7.2–17.10, 17.12–17.14, 17.16, 17.17, 17.22–17.24 of paragraph 17, sub-paragraphs 19.2, 19.3.1, 19.3.2, 19.4 of paragraph 19, sub-paragraphs 20.1–20.8 of paragraph 20, paragraph 21, sub-paragraphs 22.1–22.3, 22.5, 22.6 of paragraph 22 of the list;
disabled persons of groups I and II, disabled children under 18 years of age who have completed the content of the special education curriculum at the level of general secondary education for persons with intellectual disabilities – social services provided for in sub-paragraphs 19.1, 19.3.3 of paragraph 19, paragraph 251 of the list;
citizens in difficult life situations – social services provided for in sub-paragraph 19.5 of paragraph 19, sub-paragraph 20.9 of paragraph 20 of the list;
persons from among orphans and children left without parental care – social services provided for in paragraph 25 of the list;
families raising two or more children under 3 years of age born simultaneously, families raising a disabled child (disabled children) under 18 years of age, families raising children under 6 years of age in which both parents – mother (stepmother), father (stepfather) – or a parent in a single-parent family are disabled persons of group I or II – social services provided for in paragraph 23 of the list.
Free of charge, territorial centers provide social services at home in the form of:
families raising two or more children under 3 years of age born simultaneously, families raising a disabled child (disabled children) under 18 years of age, families raising children under 6 years of age in which both parents – mother (stepmother), father (stepfather) – or a parent in a single-parent family are disabled persons of group I or II – social services provided for in paragraph 23 of the list;
incapacitated citizens – social services provided for in sub-paragraphs 16.1–16.3, 16.5 of paragraph 16, sub-paragraphs 19.2, 19.3.1–19.3.3, 19.4 of paragraph 19, paragraphs 20 and 21, sub-paragraph 22.5 of paragraph 22 and paragraph 251 of the list;
low-income single incapacitated citizens – social services provided for in sub-paragraphs 17.1–17.6, 17.7.2–17.10, 17.12–17.14, 17.16, 17.17, 17.22, 17.23 of paragraph 17, sub-paragraphs 22.1–22.3, 22.6 of paragraph 22 of the list;
single disabled persons of group I and II – social services provided for in sub-paragraphs 22.1–22.3, 22.6 of paragraph 22, paragraph 251 of the list;
disabled persons of group I and II, disabled children under 18 years of age who have completed the content of the educational program of special education at the level of general secondary education for persons with intellectual disabilities – social services provided for in sub-paragraphs 19.1, 19.3.3 of paragraph 19 of the list;
citizens in difficult life situations – social services provided for in sub-paragraph 19.5 of paragraph 19, sub-paragraph 20.9 of paragraph 20 of the list.
On terms of partial payment, territorial centers provide social services at home in the form of:
single incapacitated citizens (families) whose average per capita income does not exceed 200 percent of the subsistence minimum budget approved in the established manner on average per capita – social services provided for in sub-paragraphs 17.1–17.6, 17.7.2–17.10, 17.12–17.14, 17.16, 17.17, 17.22, 17.23 of paragraph 17, sub-paragraphs 22.1–22.3, 22.6 of paragraph 22 of the list, with the exception of citizens specified in the fifth paragraph of the second part of this paragraph;
low-income single incapacitated citizens – social services provided for in sub-paragraph 17.24 of paragraph 17, paragraph 24 of the list.
The amount of partial payment is:
for an incapacitated citizen – 60 percent of the tariff for social services;
for an incapacitated family – 50 percent of the tariff for social services for each family member.
On terms of full payment, territorial centers provide social services at home in the form of:
incapacitated citizens (families), except for citizens (families) specified in the fourth and fifth paragraphs of the second part and the second paragraph of the third part of this paragraph – social services provided for in sub-paragraphs 17.1–17.6, 17.7.2–17.10, 17.12–17.14, 17.16, 17.17, 17.22, 17.23 of paragraph 17, sub-paragraphs 22.1–22.3, 22.6 of paragraph 22 of the list;
incapacitated citizens, with the exception of citizens specified in the third paragraph of the third part of this paragraph – social services provided for in sub-paragraph 17.24 of paragraph 17, paragraph 24 of the list;
disabled persons of group I and II, except for citizens specified in the fifth paragraph of the second part of this paragraph – social services provided for in paragraph 251 of the list.
When providing social services in the form of home-based social care to a disabled family, the full payment amount is 80 percent of the social services tariff for each family member.
18. Territorial centers provide the following services free of charge in the form of urgent social care:
to victims of human trafficking, persons affected by domestic violence, terrorist acts, man-made disasters and natural calamities, persons from among orphans and children left without parental care – social services stipulated in paragraph 15 of the list;
to citizens in difficult life situations – social services stipulated in sub-paragraphs 16.1–16.4 of paragraph 16, the second paragraph of paragraph 18, sub-paragraph 20.9 of paragraph 20, sub-paragraphs 21.1, 21.2, 21.5 of paragraph 21, sub-paragraph 22.5 of paragraph 22, paragraphs 25 and 251 of the list.
19. To receive social services, a citizen or their legal representative applies to the territorial center at their place of registration (residence) and submits the following documents:
identity document;
a standard document on the right to benefits (disability certificate, Great Patriotic War veteran certificate, etc.) for citizens belonging to the category of beneficiaries;
consent to the processing of special personal data in cases provided for by personal data legislation.
A written application is submitted for the provision of the following social services:
social services provided in the forms of inpatient social care, semi-inpatient social care, home-based social care;
social services stipulated in sub-paragraph 20.9 of paragraph 20, paragraphs 18, 25 and 251 of the list, provided in the forms of non-inpatient and urgent social care;
social services stipulated in sub-paragraph 19.5 of paragraph 19, sub-paragraph 20.2 of paragraph 20 of the list, provided in the form of non-inpatient social care.
20. When determining the terms of payment for social services, territorial centers apply:
the subsistence minimum budget per capita, approved in the established manner, valid on the date of application for social services;
the per capita income of a disabled citizen (family), calculated for the month preceding the month of application for social services, in accordance with paragraph 21 of this Instruction.
21. The per capita income of a disabled citizen is calculated by summing their income received for the month preceding the month of application for social services.
The per capita income of a disabled family is calculated by dividing the sum of the income of family members received for the month preceding the month of application for social services by the number of family members.
The per capita income of a disabled citizen (family) includes:
all types of pensions, including allowances, surcharges, and increases;
wages;
income from notary, legal, entrepreneurial or craft activities, activities in the field of agro-ecotourism services, income from activities specified in paragraphs 1 and 3 of Article 337 of the Tax Code of the Republic of Belarus;
remuneration under civil law contracts;
benefits assigned in accordance with the Law of the Republic of Belarus of December 29, 2012, No. 7-Z "On State Benefits for Families Raising Children", with the exception of a lump-sum benefit in connection with the birth of a child and a lump-sum benefit for women who registered with healthcare organizations before the 12th week of pregnancy;
monthly insurance payments for compulsory insurance against industrial accidents and occupational diseases;
scholarships;
income from renting out residential (non-residential) premises.
22. Services provided for in paragraph 15 of the list are rendered to citizens over 18 years of age and families with children by the territorial center at the place of application, regardless of the place of registration (residence). To conclude an agreement for the provision of social services, citizens submit a written application and an identity document.
Citizens apply for the service to the territorial center independently or upon referral from labor, employment and social protection bodies, education, internal affairs, healthcare organizations, other state bodies and organizations.
In case of urgent need for the service provided for in paragraph 15 of the list, and in the absence of an identity document, the service is provided on the basis of a written application with subsequent submission of an identity document within 3 working days from the date of application. In case of loss of an identity document, the citizen applies to the internal affairs bodies for its restoration.
To provide social services provided for in paragraph 15 of the list, a "crisis" room is created in the territorial center, the regulations of which are approved by the director of the territorial center. The "crisis" room, by decision of local executive and administrative bodies, may be located in isolated residential premises of the state or private housing stock or in premises assigned to other institutions and organizations.
The "crisis" room is a specially equipped separate room where the necessary conditions for safe living are created.
Access to the "crisis" room is provided around the clock in the manner established by the director of the territorial center.
During the stay of citizens in the "crisis" room, their household and other living conditions are carried out on the principles of self-service. When a family with children moves in, childcare is carried out by the parent.
During the stay in the "crisis" room, citizens' meals, if necessary, are provided from the local budget, funds received from income-generating activities, gratuitous (sponsorship) assistance, and other sources not prohibited by law.
Persons from among orphans and children left without parental care, who arrived in the district upon distribution to their first workplace, are provided with the services stipulated in paragraph 15 of the list for a short period to resolve the issue of providing a place of residence.
The period of stay in the "crisis" room for citizens is determined in the agreement and may be extended taking into account the circumstances of a specific life situation.
23. To provide social services stipulated in subparagraphs 16.1–16.3, 16.5 of paragraph 16 of the list, citizens submit the documents specified in the second–fourth paragraphs of the first part of paragraph 19 of this Instruction.
In the territorial center, to provide social services stipulated in paragraph 16 of the list, a specially equipped workplace located in close proximity to the entrance (information and reference service) may be created.
24. To conclude a social service agreement for the services listed in paragraph 17 of the list, citizens shall submit the documents specified in paragraphs two to four of part one of paragraph 19 of these Instructions, as well as a medical certificate of health status and/or a conclusion from the medical advisory board (VKK) containing information on the presence of medical indications and/or the absence of medical contraindications for the provision of social services in the form of home-based social care.
Employees of the territorial center shall, within three working days from the date of the citizen's application, request from state bodies and other organizations:
a certificate of residence and family composition;
information on the amount of pension received for the month preceding the month of application for social services – for single disabled citizens.
In case of repeated applications within a calendar year (from January 1 to December 31) for social services provided for in paragraph 17 of the list, the documents (information) specified in parts one and two of this paragraph shall be submitted and requested if the circumstances (information) specified therein have changed.
For the provision of social services provided for in paragraph 17 of the list, household brigades may be established in the territorial center.
25. To conclude a social service agreement for the services listed in paragraphs 18 and 25 of the list, citizens shall submit the documents specified in paragraphs two to four of part one of paragraph 19 of these Instructions.
To conclude a social service agreement for the services listed in subparagraphs 19.1, 19.3.3 of paragraph 19, paragraph 251 of the list, citizens shall submit the documents specified in paragraphs two to four of part one of paragraph 19 of these Instructions, as well as an individual rehabilitation and habilitation program for a disabled person, an individual rehabilitation and habilitation program for a disabled child (hereinafter – individual rehabilitation and habilitation program for a disabled person) or a conclusion from the medical advisory board (VKK).
Employees of the territorial center shall, within three working days from the date of application, conduct an assessment of the citizen's material and living conditions, drawing up an act of assessment of the citizen's material and living conditions in the form according to Appendix 2 (hereinafter – assessment act).
For the provision of social services provided for in paragraph 18 of the list, a plan for the patronage support of a citizen (family) shall be developed in the form according to Appendix 4.
When providing social services provided for in paragraph 18 of the list, and if interdepartmental cooperation is necessary to overcome a difficult life situation, a patronage council may be established in the territorial center. The patronage council may include specialists from healthcare organizations, educational institutions, internal affairs bodies, commissions for juvenile affairs, and other organizations.
The functioning of the patronage council is ensured by the territorial center.
26. To conclude a social service agreement for the services listed in subparagraphs 20.1, 20.3–20.9 of paragraph 20 of the list, citizens shall submit the documents specified in paragraphs two to four of part one of paragraph 19 of these Instructions.
Social services provided for in subparagraph 20.9 of paragraph 20 of the list shall be provided to hearing-impaired individuals regardless of the disability group.
27. The provision of social services provided for in paragraph 21 of the list shall be carried out in accordance with the legislation on psychological assistance.
For the provision of social services provided for in paragraph 21 of the list, special premises (psychological relief room, sensory room, individual and group work rooms) shall be equipped in the territorial center.
28. To conclude an agreement for the provision of social services stipulated in paragraph 22 of the list, citizens shall submit the documents specified in paragraphs two to four of part one of paragraph 19 of these Instructions.
For the provision of social services stipulated in sub-paragraphs 22.1–22.5 of paragraph 22 of the list, disabled persons of groups I and II, disabled children under 18 years of age who have completed the content of the educational program of special education at the level of general secondary education for persons with intellectual disabilities, shall additionally submit an individual rehabilitation and habilitation program for the disabled person or a conclusion from the medical advisory commission (VKK).
For the provision of social service stipulated in sub-paragraph 22.5 of paragraph 22 of the list, citizens in difficult life situations, with the exception of citizens specified in part two of this paragraph, shall additionally submit a medical certificate of health status.
In the territorial center, for the provision of social service stipulated in sub-paragraph 22.5 of paragraph 22 of the list, a specially equipped separate room shall be created, intended for the collection, storage, and issuance of technical means of social rehabilitation to citizens (families) in need (rental point).
29. To conclude an agreement for the provision of social services stipulated in paragraph 23 of the list, citizens shall submit the documents specified in paragraphs two and four of part one of paragraph 19 of these Instructions, as well as:
child's birth certificate (children's birth certificates);
disability certificate – for families raising a disabled child (disabled children), and families in which parents (parent) are disabled;
a certificate stating that the citizen is a student, with additional information about receiving education at home – for disabled children studying in an educational institution with education received at home.
Employees of the territorial center shall conduct an inspection of the family's living conditions within three working days from the date of application, with the drawing up of an inspection report.
Services stipulated in paragraph 23 of the list shall not be provided if:
the child (disabled child) receives basic or special education in educational institutions (with the exception of receiving education at home);
the disabled child receives basic or special education in educational institutions, and additional education for children and youth – at home;
services are provided in the form of semi-stationary social services, as well as the service stipulated in paragraph 12 of the list;
care for a disabled child (disabled children) with the receipt of a disabled child care allowance is carried out by another person who is not a parent (mother (stepmother), father (stepfather), legal representative).
30. To conclude an agreement for the provision of social services in the form of semi-stationary social services, citizens shall submit the documents specified in paragraphs two to four of part one of paragraph 19 of these Instructions, a medical certificate of health status and (or) a conclusion from the medical advisory commission (VKK), containing information about the absence of medical contraindications for the provision of social services in the form of semi-stationary social services, as well as accompanying documents from correctional and developmental education and rehabilitation centers – for graduates of these centers.
Employees of the territorial center shall conduct an inspection of the citizen's living conditions within three working days from the date of application, with the drawing up of an inspection report, and request from state bodies and other organizations:
a certificate of residence and family composition;
information on the amount of pension received for the month preceding the month of application for social services – for single non-working citizens aged 60 and older who have reached the generally established retirement age and are entitled to a state pension, as well as single disabled persons of groups I and II who have applied for social services provided for in sub-paragraph 17.24 of paragraph 17 of the list.
31. To conclude an agreement for the provision of social services in the form of inpatient social services and home-based social services, as well as for the provision of social services provided for in sub-paragraph 17.24 of paragraph 17, paragraph 24 of the list, citizens shall submit the documents specified in sub-paragraphs two to four of the first part of paragraph 19 of this Instruction, as well as a medical certificate of health and (or) a conclusion of the medical advisory commission (VKK) containing information on the presence of medical indications and (or) the absence of medical contraindications for the provision of social services in the form of inpatient social services, home-based social services, as well as for the provision of social services provided for in sub-paragraph 17.24 of paragraph 17, paragraph 24 of the list.
Employees of the territorial center shall, within three working days from the date of application, conduct an examination of the material and living conditions of the citizen with the drawing up of an inspection report and request from state bodies and other organizations:
information on the amount of pension received for the month preceding the month of application for social services – for single incapacitated citizens;
information on the absence of care for the citizen applying for social services by a person receiving a care allowance for a disabled person of group I or a person who has reached the age of 80;
a certificate of residence and family composition.
32. The decision to conclude an agreement for the provision of social services shall be made by the head of the territorial center within five working days after receiving the last document (information) necessary for the provision of social services.
321. To provide a disabled person (disabled child) with services provided for in sub-paragraphs 19.1, 19.2, 19.3.3 of paragraph 19, paragraph 22, paragraph 251 of the list, and other services for the purpose of social rehabilitation, habilitation based on an individual rehabilitation and habilitation program for a disabled person, an individual plan for social rehabilitation and habilitation of a disabled person (disabled child) shall be developed in the territorial center of social services for the population in the form according to Appendix 5.
33. For the organization and provision by territorial centers in the form of home-based social services of social services provided for in sub-paragraphs 17.1–17.6, 17.7.2–17.10, 17.13, 17.14, 17.16, 17.17, 17.22–17.24 of paragraph 17, sub-paragraphs 19.1, 19.3.3, 19.5 of paragraph 19, sub-paragraph 20.9 of paragraph 20, sub-paragraph 22.6 of paragraph 22, paragraphs 23, 24 and 251 of the list (when serving at least two families (persons) within one day), employees of territorial centers shall, in the manner and on the terms determined by employment contracts:
be issued multi-use tickets for urban road passenger transportation in regular service, urban passenger electric transport and metro, or their cost shall be compensated, but not exceeding the cost of a multi-use ticket for a month;
be compensated for the cost of tickets for suburban road passenger transportation in regular service and railway transport for general use, but not exceeding the cost of travel on the corresponding route;
be provided with mechanization means, bicycles.
During the period of bicycle use, tickets specified in the second and third paragraphs of the first part of this clause are not issued and their cost is not reimbursed.
To provide social services stipulated in sub-paragraph 17.24 of paragraph 17, sub-paragraphs 19.1.1, 19.1.2, 19.2, 19.3.3–19.3.5 of paragraph 19 and sub-paragraph 22.4 of paragraph 22 of the list, in the form of inpatient and/or semi-inpatient social care, rehabilitation and labor workshops, computer classes, and rooms for interest groups (clubs, sections) equipped with special equipment, adaptations, and tools are established in territorial centers.
34. Citizens, when submitting an application for social services, have the right to personally submit documents that are requested by territorial centers in accordance with this Instruction.
35. The conditions for providing social services by territorial centers are reviewed:
annually from February 1, based on the per capita income of a disabled citizen (family), calculated on the basis of income actually received in December of the preceding year, and the subsistence minimum budget per capita, approved at prices of December of the preceding year;
when the composition of the family of disabled citizens (families) changes, as well as when disabled citizens (families) move into the category of single disabled citizens (families) – from the first day of the month following the month in which the changes occurred;
when tariffs for social services change in the manner established by law.
CHAPTER 4
PROCEDURE AND CONDITIONS FOR PROVIDING SOCIAL SERVICES BY FAMILY AND CHILDREN CENTERS
36. To conclude a social services agreement, a citizen or their legal representative applies to the family and children center and submits the following documents:
identity document;
a document of the established form confirming the right to benefits (disability certificate, large family certificate) for citizens belonging to the category of beneficiaries;
consent to the processing of special personal data in cases provided for by personal data legislation.
The decision to conclude a social services agreement is made by the head of the family and children center within five working days after receiving the last document (information) necessary for providing social services.
A written application is submitted for concluding a social services agreement as stipulated in paragraph 26, sub-paragraphs 27.1–27.4 of paragraph 27, paragraph 28, sub-paragraphs 29.2, 29.3.2–29.3.4 of paragraph 29, sub-paragraphs 30.2–30.3 of paragraph 30, paragraphs 31 and 32 of the list.
37. The provision of social services stipulated in paragraphs 26–31 of the list, within the established norms and standards, is carried out by family and children centers free of charge.
38. Social services stipulated in paragraph 32 of the list, within the established norms and standards of provision of services by state social service institutions free of charge, are provided to:
families raising two or more children under 3 years of age born simultaneously;
families raising a disabled child (children with disabilities) under 18 years of age;
families raising children under 6 years of age, in which both parents – mother (stepmother), father (stepfather) – or the parent in a single-parent family are disabled of group I or II.
Services stipulated in paragraph 32 of the list are not provided if:
the child (child with disabilities) receives basic or special education in educational institutions (except for home-based education);
the child with disabilities receives basic or special education in educational institutions, and additional education for children and youth – at home;
services are provided in the form of semi-residential social services, as well as the service specified in paragraph 12 of the list;
care for a disabled child (disabled children) with the receipt of a disabled child care allowance is carried out by another person who is not a parent (mother (stepmother), father (stepfather), legal representative).
39. To conclude an agreement for the provision of social services provided for in subparagraphs 27.1–27.4 of paragraph 27, subparagraphs 29.2, 29.3.2–29.3.4 of paragraph 29, paragraph 30 of the list, citizens submit the documents specified in the first part of paragraph 36 of this Instruction.
40. Social services provided for in paragraph 26 of the list are rendered in accordance with paragraph 22 of this Instruction.
41. Social services provided for in paragraph 28 of the list are rendered in accordance with the first, third–sixth parts of paragraph 25 of this Instruction.
42. The provision of social services provided for in paragraph 31 of the list is carried out in accordance with the legislation on the provision of psychological assistance.
To provide social services provided for in paragraph 31 of the list, the center is equipped with special premises (psychological relief room, sensory room, individual and group work rooms).
43. To conclude an agreement for the provision of social services provided for in paragraph 32 of the list, citizens submit an identity document, as well as:
child's birth certificate (children's);
disability certificate – for families raising a disabled child (disabled children), and families in which parents (parent) are disabled;
a certificate stating that the citizen is a student, with additional information on receiving education at home – for disabled children studying in an educational institution with education at home.
44. To make a decision on concluding an agreement for the provision of social services provided for in paragraphs 28 and 32 of the list, employees of the family and children center, within three working days from the date of application of the citizen (family), if necessary, conduct an examination of their material and living conditions with the drawing up of an inspection report.
CHAPTER 5
PROCEDURE AND CONDITIONS FOR THE PROVISION OF SOCIAL SERVICES BY CENTERS FOR SOCIAL REHABILITATION AND HABILITATION OF DISABLED PERSONS
45. Social services are provided by the rehabilitation center on the basis of a social services agreement in the form according to Appendix 1 to the resolution approving this Instruction, to disabled persons, including disabled children under 18 years of age, who have completed the mastering of the content of the educational program of special education at the level of general secondary education for persons with intellectual disabilities (hereinafter – disabled person).
46. Social services are provided in the rehabilitation center during the disabled person's course of social rehabilitation and habilitation lasting up to 1 month with a frequency of no more than once a year.
47. Social services for undergoing a course of social rehabilitation and habilitation in the rehabilitation center are primarily provided to disabled children specified in paragraph 45 of this Instruction, disabled persons of groups I and II who have not reached the generally established retirement age, and who have been recognized as disabled for the first time.
48. Referral of a disabled person to a rehabilitation center is carried out by the committees for labor, employment and social protection of regional and Minsk city executive committees, departments (divisions) for labor, employment and social protection of city, district executive committees, departments (divisions) of social protection of local administrations of districts in cities (hereinafter referred to as bodies for labor, employment and social protection) on the basis and during the period of validity of the individual rehabilitation and habilitation program for the disabled person and (or) previously issued recommendations by the rehabilitation center for repeated social rehabilitation and habilitation courses.
49. To conclude a social services agreement, a citizen (his legal representative) applies to the territorial center at the place of registration (place of residence) and submits the following documents:
application in the form according to Appendix 6;
identity document;
document confirming the authority of the legal representative – in case of application by a legal representative;
disabled person's certificate;
individual rehabilitation and habilitation program for the disabled person;
extract from medical documents;
medical certificate of health status, containing information about the absence of contact with infectious patients;
consent to the processing of special personal data in cases provided for by personal data legislation.
If the applicant fails to submit the documents specified in the first part of this paragraph, the application will not be accepted.
50. The package of documents specified in the first part of paragraph 49 of this Instruction, within 5 working days from the date of receipt of the application, is sent by the territorial center to the body for labor, employment and social protection, which, if there are available places, within 3 working days from the date of receipt of the documents, issues a referral to the rehabilitation center, of which the citizen is informed.
51. In the absence of available places in the rehabilitation center, a social services agreement is not concluded with the citizen, of which he is informed within 3 working days from the date of receipt of the documents by the body for labor, employment and social protection.
52. In the inpatient form of social services, rehabilitation centers provide social services stipulated in paragraph 33, subparagraphs 34.1, 34.3–34.13 of paragraph 34, paragraphs 35, 36, 37, 38 of the list.
In the semi-inpatient form of social services, rehabilitation centers provide social services stipulated in paragraph 33, subparagraphs 34.2, 34.3, 34.7–34.13 of paragraph 34, paragraphs 35, 36, 37, 38 of the list.
53. The provision of social services to disabled persons, as stipulated in paragraphs 33–38 of the list, within the established norms and standards, is carried out by rehabilitation centers free of charge.
54. If a disabled person undergoing a course of social rehabilitation and habilitation and receiving social services in the form of inpatient social care requires accompaniment, the accompanying person is provided with accommodation in the rehabilitation center free of charge.
A disabled person undergoing a course of social rehabilitation and habilitation in the rehabilitation center in the form of inpatient social care together with an accompanying person is not provided with the services stipulated in subparagraphs 34.7–34.13 of paragraph 34 of the list.
The need for an accompanying person is determined on the basis of an individual rehabilitation and habilitation program for the disabled person, which specifies the disabled person's need for constant assistance, subject to medical indications defined by the list of medical indications and medical contraindications for the provision of social services in social service institutions, established by Resolution No. 3/4 of the Ministry of Labor and Social Protection of the Republic of Belarus and the Ministry of Health of the Republic of Belarus dated January 10, 2013 "On establishing the list of medical indications and medical contraindications for the provision of social services in social service institutions".
55. Upon admission of a disabled person to a rehabilitation center, an individual rehabilitation plan is drawn up based on a comprehensive assessment of their needs and capabilities, in the form according to Appendix 31, which includes a specific list of social services.
Upon completion of the course of social rehabilitation and habilitation of a disabled person, a conclusion on the results of rehabilitation and recommendations for further social rehabilitation and habilitation in the territorial center at the place of registration (residence) and (or) repeated completion of the course of social rehabilitation and habilitation in a stationary social service institution are issued.
An extract from the individual rehabilitation plan, recommendations for further social rehabilitation and habilitation are issued to the disabled person (their legal representative), and with their consent, a second copy is sent to the territorial center at the disabled person's place of registration (residence) within three working days from the date of completion of the social rehabilitation and habilitation course.
