Question: What medical indications must a disabled citizen have to receive caregiver services?
Answer: Injuries and (or) diseases and (or) their consequences, leading to a severely expressed (FC 4) limitation of self-care ability and a severely expressed (FC 4) limitation of independent movement ability.
Conditions for providing financial assistance. How is the amount of financial assistance determined?
According to paragraphs 4, 7 of the Instruction approved by Resolution No. 9 of the Ministry of Labor and Social Protection of the Republic of Belarus dated August 3, 2001.
Financial assistance is provided to pensioners, disabled persons, and disabled children in cases of:
· harm to their health and (or) property as a result of natural disasters (fires, droughts, floods, and others), man-made disasters, theft of personal property;
· other situations that objectively disrupt their normal life and are difficult to resolve independently, requiring prompt financial assistance.
Financial assistance is usually provided no more than once within a calendar year, and its amount is determined individually in each specific case. When making a decision, the following are taken into account:
· the need of the applicant for assistance;
· the amount of pension received by them;
· their material and living conditions;
· the possibility of receiving financial support from able-bodied relatives.
What is a personal assistant service?
Since January 6, 2023, the personal assistant service has been included in the types of social services defined by Law of the Republic of Belarus No. 395-Z "On Social Services" of May 22, 2000.
It involves assisting disabled persons in organizing and carrying out independent and self-sufficient life activities, including promoting the acquisition of self-care skills, assisting in planning and organizing daily life, making decisions in various life situations, establishing communicative connections with other people, and other types of assistance.
This may include searching for necessary information, filling out documents, visiting workshops, day care departments of territorial centers for social services, concerts, exhibitions, providing first aid, calling a doctor, informing relatives about health status, etc.
The main goal of introducing such a service is to expand the opportunities for people with disabilities, their participation in society, including carrying out socially useful activities. At the same time, an individual approach is ensured in each specific case.
For whom is the personal assistant service intended?
This type of service is provided for the following categories of persons:
· disabled persons with musculoskeletal disorders, visual impairments, intellectual disabilities, corresponding to FC 4, and (or) moderate or severe limitation of the ability to control their behavior, corresponding to FC 2 or FC 3, and living with able-bodied relatives who are legally obliged to support them.
Note:
For this category of persons, the service will be provided for up to 20 hours per month.
· disabled individuals with musculoskeletal disorders and visually impaired individuals with limitations in life activities (ability to move independently and/or ability to orient themselves) corresponding to FC 4, and living separately from able-bodied relatives legally obliged to support them, and single disabled individuals.
Note:
For this category of persons, the service will be provided for up to 40 hours per month.
· disabled individuals with intellectual disabilities, with limitations in life activities (ability to control their behavior) corresponding to FC 2 or FC 3, living separately from able-bodied relatives legally obliged to support them, and single disabled individuals.
Note:
For this category of persons, the service will be provided for up to 60 hours per month.
Who has the right to be a guardian or trustee?
Guardians and trustees may be legally capable persons of both sexes, with the exception of:
persons suffering from chronic alcoholism, drug addiction, substance abuse;
persons who, due to their health condition, cannot exercise the rights and perform the duties of a guardian or trustee (the list of diseases, in the presence of which persons cannot be guardians or trustees, is established by the Ministry of Health);
persons deprived of parental rights by a court;
former adoptive parents, if the adoption was canceled due to improper performance of duties by the adoptive parent;
persons removed from the duties of a guardian or trustee for improper performance of their assigned duties;
persons with a criminal record for intentional crimes, as well as persons convicted of intentional grave or especially grave crimes against a person;
persons whose children were recognized as needing state protection due to the failure or improper performance by these persons of their duties to raise and support children.
Are payments due for an individual acting as a guardian of an incapacitated person?
No payments are due. The duties of guardianship and trusteeship are performed free of charge. A guardian or trustee has the right to reimbursement for expenses incurred from their own funds for the repair, maintenance of the ward's property, and other necessary needs.
