1. Who is considered a young professional?
Young professionals are graduates of higher and secondary specialized educational institutions who have completed a full course of study, funded by the republican and (or) local budgets, and assigned to work by a personal placement commission.
That is, schematically: placement — completion of education (full-time only), obtaining a diploma (for doctors + internship) — assignment to work — arrival at the workplace.
2. Does a young professional who studied at their own expense have the same status?
In accordance with paragraph 5 of Article 84 of the "Education Code of the Republic of Belarus," graduates who received higher or secondary specialized education in full-time study at the expense of individuals or their own funds, at their request and if there are job vacancies remaining after placement, are assigned to work. Consequently, they are considered young professionals and, upon arrival at work, are entitled to all guarantees and compensations provided by law for young professionals.
3. Who are "targeted" young professionals?
Targeted training of specialists is an agreement between a state enterprise or organization on one side and an educational institution on the other. Under this agreement, the enterprise sends a request to the educational institution for the training of a specific specialist in a specific (needed by the enterprise) specialty. For "targeted" students, a separate competition is established upon admission (within the control figures allocated to the educational institution). Their education is also funded by the state budget.
A "targeted" young professional must work under placement for the employer who submitted the initial request, based on which the targeted recruitment of applicants was carried out.
4. Employment
The employer is obliged to hire the arriving young professional and provide them with the conditions specified in the work assignment certificate.
The regulation prohibits the dismissal of young professionals or their transfer to work unrelated to their acquired specialty or qualification before the end of their placement period. Exceptions include:
- transition to an elected position;
- decision by the educational institution to reassign the young professional or issue them a certificate of free employment;
- enrollment in a higher level (stage) educational institution in full-time education;
- employer's violation of labor legislation, collective or employment contract;
- dismissals at the employer's initiative in accordance with paragraphs 1, 2, 4 – 9 of Article 42 of the Labor Code of the Republic of Belarus (hereinafter - LC) and due to circumstances beyond the control of the parties, provided for in paragraphs 1-3, 5, 6 of Article 44 of the LC.
Upon employment, young specialists conclude a contract or a fixed-term employment agreement (more on the term later).
Regardless of the form of ownership and management, the employer is not entitled to refuse a young specialist to conclude an employment agreement (contract), which, by the way, is concluded without a probationary period.
5. Can a young specialist work under assignment in place of an employee on maternity leave?
Yes. A young specialist may be employed for the period of fulfilling the duties of a temporarily absent employee, for whom the job is retained in accordance with the Labor Code of the Republic of Belarus. In accordance with paragraph 4 of part 1 of Article 17 of the LC, a fixed-term employment agreement is concluded with a young specialist.
6. What awaits a young specialist hired for the duration of the main employee's maternity leave, who returned to work earlier than the end of the leave?
After the main employee returns from parental leave, the young specialist must be provided with another workplace that allows for the mandatory assignment period to be worked off, and if this is not possible – a written refusal must be issued so that the employee can contact their educational institution for reassignment.
7. Work-off period
A young specialist is obliged to work off 1 year after receiving vocational education (for targeted assignment – 2 years) and 2 years after receiving secondary specialized or higher education (for targeted assignment – 3 years for secondary specialized and 5 years for higher education). Accordingly, it is not allowed to conclude an employment agreement with these categories of employees for a shorter period.
The work-off period for a young specialist includes parental leave until the age of three and service in the Armed Forces of the Republic of Belarus, other troops and military formations.
And for persons who have received higher education in the field of "Healthcare", the period of mandatory work is calculated from the date of concluding an employment agreement for the position of a specialist doctor.
8. Is work during university studies included in the work-off period for assignment?
No. The work-off period is calculated from the date of concluding an employment agreement (contract) between the young specialist and the employer. Since a student is not a young specialist during their studies at an educational institution, work in this case is not taken into account.
9. Is work before reassignment included in the work-off period for assignment?
Yes. When assigning, the entire work-off period after graduating from an educational institution is taken into account.
10. What monetary payments are provided for young specialists?
Financial assistance is paid to:
young specialists, as well as graduates specified in paragraph 5 of Article 84 of the Education Code of the Republic of Belarus, – in the amount of the monthly scholarship assigned to them in the last semester (half-year) before graduation;
young workers (employees) who have received vocational education, – based on the tariff rate for their assigned qualification (rank, class, category) or the corresponding salary.
Graduates directed to work as pedagogical staff are paid financial assistance by the educational institution for 45 calendar days from the republican or local budgets, based on the monthly scholarship assigned to them in the last semester (half-year) before graduation, no later than the issuance of the work assignment certificate.
If young specialists and graduates did not receive scholarships in the last semester (half-year) before graduation, they are paid appropriate financial assistance based on the social scholarship established on the graduation date.
And, of course, additional payments provided for by the collective agreement. Each organization has its own.
11. What is the timeframe for the payment of financial assistance?
Financial assistance is paid by the employer within one month from the date of concluding an employment contract (agreement) with the graduate in full, regardless of the number of days off used by them.
12. What benefits are guaranteed to young specialists in connection with relocation (lump-sum relocation allowance)?
In accordance with Article 96 of the Labor Code of the Republic of Belarus, employees, persons who have completed their education, relocating to work in another locality due to transfer, assigned through organized recruitment or in accordance with preliminary agreements, concluded contracts or applications, are reimbursed: a lump-sum allowance for the employee themselves, the person who has completed their education, in the amount of their monthly tariff rate (salary) at the new place of work, and for each relocating family member in the amount of one-fourth of the allowance for the employee themselves, the person who has completed their education.
13. Is a lump-sum allowance paid to young specialists if they are assigned to work at their permanent place of residence?
If a young specialist is assigned to work at their permanent place of residence, a lump-sum relocation allowance is not paid. In this case, the permanent place of residence before the assignment is considered to be the locality where the student (pupil) lived before entering studies.
14. Is a lump-sum allowance paid to young specialists if they are assigned to work at the location of the educational institution where they studied?
Young specialists and their family members, assigned to work by personal distribution to the location of the educational institution where they studied, are paid a one-time relocation allowance if they permanently resided in another locality before their studies. If, by the time of distribution, the student has obtained permanent registration in the locality where the educational institution is located and where they are assigned to work, they are not entitled to receive the specified allowance.
15. Is the employer obliged to provide housing?
Unfortunately, the legislation does not guarantee housing provision at the place of assignment for young specialists. The only guarantee in this area, enshrined at the state level, is the right of a young specialist who has arrived at the place of assignment to be registered as a person in need of improved housing conditions, without additional requirements.
16. In what case is a young specialist not considered a "young specialist"?
If a graduate has received a certificate of independent employment, they do not have the status of a young specialist, and, of course, after the full term of service.
