Driving a vehicle by a person under the influence of alcohol or a state caused by the consumption of narcotic drugs, psychotropic, toxic or other intoxicating substances
The following types of liability are provided for driving a vehicle while intoxicated or in a state caused by the consumption of narcotic drugs, psychotropic, toxic or other intoxicating substances, or for transferring control to such a person, as well as for refusing to undergo a check (examination) in the prescribed manner to determine the specified state.
A person who commits such an offense for the first time shall be subject to administrative liability under Part 1 of Article 18.16 of the Code of Administrative Offenses in the form of a fine ranging from fifty to one hundred basic units with deprivation of the right to drive vehicles for a period of three years.
In case of repeated commission of a similar offense within a year after the imposition of an administrative penalty, the person shall be subject to criminal liability under Part 1 of Article 317-1 of the Criminal Code. The maximum penalty provided is imprisonment for up to two years with deprivation of the right to hold certain positions or engage in certain activities for up to five years.
It should be noted that in this case, special confiscation of the vehicle driven by the person while intoxicated or in a state caused by the consumption of narcotic drugs, psychotropic, toxic or other intoxicating substances is applied.
For 2018 and the elapsed period of 2019, prosecutors of the district supported the prosecution in 7 criminal cases of this category. Currently, the convicted persons are serving their sentences.
