Attention to Individuals (Regarding the Regulation of Spread and Numbers of Certain Plant Species)
A new version of the Code of the Republic of Belarus on Administrative Offenses comes into force on June 19, 2026. Chapter 16 of the Code, which provides for liability in the field of environmental safety and environmental management, includes, among other changes, a new Article 16.46 "Failure to carry out measures to regulate the spread and numbers of certain plant species". This article establishes liability in the form of a fine of up to ten basic units for land or water body users who fail to fulfill their obligations established by legislation on the protection and use of flora, related to carrying out measures to regulate the spread and numbers of plant species whose spread and numbers are subject to regulation.
The list of plant species whose spread and numbers are subject to regulation is approved by Resolution of the Council of Ministers of the Republic of Belarus No. 1002 dated December 7, 2016. These plants include:
1. Sosnowsky's hogweed;
2. Mantegazzi's hogweed;
3. Canadian goldenrod;
4. Giant goldenrod;
5. Boxelder;
6. Industrial hemp;
7. Opium poppy;
8. Black locust;
9. Prickly cucumber;
10. Ragweed.
Please note that for individuals, administrative penalties will be applied to land users for the cultivation of the specified plants on land plots from June 19, 2026, in accordance with Article 16.46 of the Code of Administrative Offenses of the Republic of Belarus.
