On Public Procurement

Monitoring conducted by the district prosecutor's office in the past period of 2018 revealed a negative trend in compliance with legislative requirements during the procurement of goods (works, services) by economic entities in the district.

The district prosecutor's office systematically identifies violations during the conduct and formalization of procurement results. Moreover, the identified violations are of a similar nature and are characteristic of virtually all economic entities.

For example, an annual public procurement plan must be approved and published on the official website of the "Tenders" information system by March 8 each year. Conducting public procurement of goods (works, services) without the corresponding publication of the procurement plan is unacceptable. However, these requirements are not observed by the majority of economic entities.

Violations were also identified regarding the choice of procurement procedure, and the timely publication of information about ongoing and completed public procurements.

In addition to violations of legislative requirements in public procurement, the district prosecutor's office also identified facts of legislative violations in procurement carried out using enterprises' own funds.

Thus, the types of procurement procedures using own funds, as well as the conditions for their application and conduct, requirements for concluding and executing procurement contracts, and other provisions related to procurement, are determined by organizations in the procedure for procurement using own funds, which must be published on the official website of the "Tenders" information system. However, a number of enterprises in the district did not develop a procedure for conducting procurement and did not publish it on the official website of the "Tenders" information system.

Following the identified violations, by order of the district prosecutor, 11 individuals were brought to administrative responsibility for violating legislative requirements in the procurement of goods (works, services).
